NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 26, 1997, executed by Borrowers, Anna M Nutter and Perry Wayne Nutter, to Nicholas W. Johnson, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 119, at Page 271. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 634 Beechview Road, Mount Hope, WV 25880. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 9, 2022, of record in the Clerk’s Office in Book 5075, Page 7939. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:
9th day of May, 2022
at 11:45 a.m.
BEGINNING at a concrete monument found set at the end of a fence line, said monument being a corner to the Thomas McCormick 1.00 acre lot; thence with McCormick S 00-02 W 109.00 feet to a railroad spike; thence S 00-02 W 9.24 feet to a 5/8 inch iron pin placed 15 feet north of the centerline of the old Turnpike (Jim Davis Road); thence leaving McCormick and with said Turnpike S 82-33 W 192.44 feet; thence S 85-42 W 27.75 feet; thence S 86-29 W 53.91 feet; thence S 88-51 W 114.40 feet to a 5/8 inch iron pin placed on the north side of said Turnpike 15 feet north of the centerline thereof, said iron pin being a corner to the Roger and Marsha Pauley 2.18 acre tract of land as shown on a map made by James E. Cook, P.E., May 20, 1977; thence leaving said Turnpike and with the Pauley lot N 51-29 E 294.63 feet passing the Pauley corner at 294.63 feet for a total distance of 351.03 feet to a 5/8 inch iron pin placed in the field; thence with a new division line through the C. H. Martin residue S 71-22 E 118.25 feet to a 5/8 inch iron pin placed in the field; thence S 00-02 W 30.96 feet to the point of beginning, and containing 1.102 acres, more or less.
Being the same property conveyed to Anna M Nutter and Perry Wayne Nutter by the Deed dated August 26, 1986 and recorded in Deed Book 715 at Page 440 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
