By virtue of that certain Deed of Trust made by Charles Schlegel and Paula Schlegel, to James T. McClure, Trustee, dated the 21st day of September, 2018, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1572, at page 136, and that certain Appointment of Successor Trustee, dated the 25th day of February, 2022, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1650, at page 266, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 20th day of April, 2022, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, the following described property (“Property”) situate at 43 Walnut Avenue, Wheeling, Ohio County, West Virginia 26003, and being more particularly described as follows:
That certain lot which is shown and defined as Lot Numbered Seventy-Seven (77) on the “Map of Woodlawn,” said Map being the Map of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Plat Book No. 1, at page 112; together with the residence and improvements thereon and the hereditaments and appurtenances thereunto belonging.
The said parties of the second part hereby covenant with the said parties of the first part that they will not permit or cause to be erected within the space of twenty-five (25) feet measured from the front lone of the lot hereby conveyed any building or other structure whatsoever excepting a porch, piazza, or stoop.
Being the same property conveyed to Paula Schlegel and Charles Schlegel by deed dated August 26, 2000, and made of record in Deed Book 723, at page 201.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; including especially but not limited to the Lien of Main Street Bank secured by Deed of Trust dated September 21, 2018, and recorded in the Ohio County Clerk’s Office in Deed of Trust Book 1572, at page 136; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
