TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated March 20, 2014, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4019, at Page 418, Jeffrey Alexander Legg did convey unto Dru A. Shope, Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on Monday, May 23, 2022 at 5:51 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Jefferson District, Kanawha County, West Virginia, and more particularly described as follows: BEGINNING at an iron pin in the southerly line of W.Va. Secondary Route No. 67/8, said corner being located N. 59 deg. 40′ E., 80.0 feet along W.Va. Secondary Route No. 67/8 from a reference corner, said reference corner being the northeasterly front iron pin corner in the southerly line of said Route No. 67/8 of the Reserved Lot of Jarrett Addition to Sutherland Subdivision, of record in the aforesaid Clerk’s Office in Map Book No. 24, at Page 5, and being property now or formerly owned by Denver Lee Cain and Diana Lynn Cain; thence, with said Route No. 67/8, N. 59 deg. 40′ E., 75.0 feet to an iron pin, said iron pin also being the northwesterly front iron pin corner of property now or formerly owned by Richard A. Ervin and Nancy K. Erin; thence, with the Ervin line, S. 30 deg. 20′ E., 125.0 feet to an iron pin corner; thence, S. 59 deg. 40′ W., 75.0 feet to an iron pin corner, said corner being the rear southeasterly corner of property now or formerly owned by Terry Marshall Austin and Virginia Massengale Austin; thence, with the Austin line N. 30 deg. 20′ W., 125.0 feet to the place of beginning, containing 0.215 acre, more or less. This conveyance is made subject to the restrictive covenants, reservations, public utility easements and rights of way as contained in the deed from James R. Jarrett and Geraldine Jarrett, his wife, to Terry Marshall Austin and Virginia Massengale Austin, his wife, bearing date the 1st day of January, 1974, of record in the aforesaid Clerk’s Office. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2524 Shadyside Rd., St. Albans, WV 25177. AND BEING the same real estate which was conveyed to Jeffrey Alexander Legg by Deed dated December 23, 2013, from Pamela Hall, Individually as heir and as Fiduciary of the Estate of Veda Louis Phelps, and Debra K. Dickerson, and James K. Phelps, II, heirs of the Estate of Veda Louise Phelps, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2871, at Page 567. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
