NOTICE OF SUBSTITUTE TRUSTEE’S SALE OF VALUABLE REAL ESTATE

Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated April 7, 2022, and of record in the Office of the Clerk of the Marshall County Commission in Deed of Trust Book 1098, at page 432, will sell at public auction to the highest bidder on:
June 7, 2022, at 10:00 a.m.,
at the front door of the Marshall County Courthouse, 600 Seventh Street, Moundsville, West Virginia, that certain property conveyed by Carl A. Cochran, II, to Ronal W. Rush, Original Trustee, by Deed of Trust dated October 29, 2019, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 1051, at page 400, and being described as follows:
Beginning at a point located on the north side of said road on or near the place of a chestnut as described in grantors and adjoiners deeds being the southwest corner of Bessie J. Rine (deceased) lands (D.B. 313, P. 228) and a corner of Patricia S. Hoskins Parcel Two: thence running with said Hoskins and line fence N. 19 degrees 00′ 39″ W. 159.78 feet to a 1/2 inch iron rod in said fence line, passing through a 12 inch iron rod at 1.40 feet; thence running with lands remaining to said Rine the following four (4) lines; N. 81 degrees 45′ 47″ 116.34 feet to a 1.2 inch iron road; thence N. 81 degrees 32′ 56″ E. 102.81 feet to a 1.2 inch iron rod; thence N. 74 degrees 36′ 14″ E. 40.09 feet to a 1/2 inch iron rod; thence S. 13 degrees 01′ 05″ E. 151.64 feet to a 1.2 inch iron rod on the north side of said road; thence with the north side of said road the following three (3) lines; S. 75 degrees 55′ 15″ W. 40.07 feet to a 1.2 inch iron rod; thence S. 76 degrees 52′ 15″ W. 99.49 feet to a 1/2 inch iron rod; thence S. 82 degrees 30′ 07″ W. 102.71 feet to the place of beginning, containing 00.894 acres, more or less, as surveyed by Charles V. Eller, County Surveyor, July 10, 1997, and shown on a plat attached to Deed Book 598, at page 7.
Being the same property conveyed to Carl A. Cochran by Richard D. Wendt and Lisa M. Wendt, by Deed dated June 1, 2018, and recorded in Marshall County Deed Book 976, at page 556.

Property Address: 859 Campbell Hill Road, Moundsville, West Virginia.
The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements,
conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. §7424(d).
