Estep, George S. Smith, Alvin Eric Smith, Gladys Elizabeth Smith aka Gladys Miller, Freddie Smith, Leonard Smith, Jennifer Pierce Stevenson, Connie Ann Lane, Frontier West Virginia Inc., Unknown Persons wners, and Martin West, Sheriff of McDowell County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of McDowell County, West Virginia, and is known as Civil Action No. CC-27-2022-C-32, and styled Appalachian Power Company vs. Doris Marie Jackson’s Unknown Heirs, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company located in the Sandy River District, McDowell County, West Virginia, and being the parcel of surface land on the Waters of Horse Creek of Tug River, identified as Tax Map 224, Parcel 34, and recorded in the office of the Clerk of the County Commission of McDowell County, West Virginia, in Deed Book 448, at page 739, and being more specifically bounded and described as follows: 17.75 AC WATERS OF HORSE CR BEGINNING at center of a Walnut Cove Knob on the divide between Horse Creek and Panther Creek; corner of the Walter McCoy land and the G.H. Blevins, N. 6-ONE-HALF W. 176 feet to a hickory tree and near a maple; thence N. 62 W. 364 feet N. 47-ONE-HALF feet W. 185; N. 25-ONE-HALF W. 217 feet to a small tree, corner of the S. H. Auville and G. H. Blevins tract of land; thence with the line of S. H. Auville as follows: N. 23 E. 132 feet, N. 29 E. 164 feet, N. 14 E. 175 feet, N. 2 E. 183 feet, N. 14 E. 175 feet, N. 19 E. 327 feet to a white oak tree, and chestnut corner of S. H. Auville; thence N. 29 W. 171 feet N. 2 E. 183 feet, N. 14 E. 283 feet along the top of a spur to a black oak; thence N. 86 E. 750 feet to two chesnut oaks in center of Walnut Cove Spur; thence S. 22-ONE-HALF E. 799 feet to a stake, near a dogwood and sourwood in line of Walter McCoy on the S. side of the Walnut Cove Hollow, and with said line S. 34 W. 1706 feet to the place of BEGINNING. And consisting of a parcel of surface land of twenty-seven (27) acres, more or less; and excepting and reserving from the above description a parcel of six acres heretofore conveyed away, but included in the above description but not herein conveyed. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the McDowell County Circuit Clerk’s office at 90 Wyoming Street, Suite 201, Welch, West Virginia, 24801, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. Gandee, Post Office Box 128, 140 West Main Street, Suite 300, Clarksburg, West Virginia, 26302-0128, or Douglas C. McElwee, 700 Virginia Street East, Suite 400, Charleston, West Virginia, 25301. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on June 27, 2022, at 2:00 p.m., in the Circuit Court of McDowell County, West Virginia, located at 90 Wyoming Street, Suite 201, Welch, West Virginia, 24801, before the Honorable Edward Kornish. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
