By virtue of that certain Deed of Trust made by Joshua Zien, to John E. Gompers, Trustee, dated the 27th day of July, 2019, and of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book No. 1047, at page 151, and that certain Appointment of Successor Trustee, dated the 31st day of January, 2022, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1096, at page 113, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 22nd day of June, 2022, at 10:30 o’clock A.M., at the front door of the Marshall County Courthouse, Moundsville, West Virginia, the following described property (“Property”) situate at 33 Zien Drive, Cameron, Marshall County, West Virginia, 26033 and being more particularly described as follows:
A certain parcel of land, situate upon the southerly side of Irish Ridge Road and the westerly side of a private roadway, hereinafter mentioned, located in the Webster District of Marshall County, West Virginia. Bounded and being more particularly described as follows:
Beginning at a point located in or near the center of the traveled part of Irish Ridge Road at its intersection with the most eastern corner of the 2.11 acre tract of land that is now standing in the name of Jerry W. Zien and Kathleen E. Zien and recorded in the Office of the Clerk of the County Commission of Marshall County, West Virginia in Deed Book 511, at page 455. Thence, leaving the last mentioned parcel of land, and now with the center of the Irish Ridge Road, N. 61 degrees 29 55 E. for a distance of 364.50 feet to a point located in the center of the traveled part of Irish Ridge Road at its intersection with the westernmost corner of the parcel of land to be described herein. The true place of beginning for the parcel of land to be described herein.
Thence from the said true place of beginning, leaving the said road, and now through the lands that are remaining to the grantors herein, S. 43 degrees 55 10 E. passing an iron bar set on line at 19.76 feet, passing an iron bar set on line at 220.05 feet, for a total distance of 460.83 feet to a set iron bar. Thence, with the same, N. 51 degrees 25 50 E. for a distance of 40.53 feet to a point located in or near the center of the traveled part of an existing private roadway or right of way. Thence, with the said roadway for the following (8) bearings and distances, N. 07 degrees 08 20 W. for a distance of 69.72 feet to a point. Thence N. 05 degrees 58 20 E. for a distance of 63.80 feet to a point. Thence N. 00 degrees 54 30 W. for a distance of 47.80 feet to a point. Thence N. 13 degrees 08 20 W. for a distance of 51.39 feet to a point. Thence, N. 34 degrees 50 10 W. for a distance of 55.18 feet to a point. Thence, N. 54 degrees 21 50 W. for a distance of 50.00 feet to a point. Thence, N. 72 degrees 18 10 W. for a distance of 109.99 feet to a point. Thence, with the same, N. 64 28 00 W. for a distance of 111.69 feet to a point located in or near the center of Irish Ridge Road. Thence leaving the said private roadway or right of way, and now with Irish Ridge Road, for the following (3) three bearings and distances, S. 02 degrees 00 00 W. for a distance of 23.92 feet. Thence, S. 36 degrees 26 40 W. for a distance of 40.41 feet to a point. Thence, S. 55 degrees 42 40 W. for a distance of 41.52 feet to the place of beginning, containing 1.541 acres, more or less, as shown upon a plat prepared by Bryan A. Payne, licensed surveyor, a true copy of which is attached hereto and intended to be recorded herewith.
Being the same property conveyed to Joshua A. Zien, a single person, by Jerry W. Zien, a married person, by deed dated August 1, 2016, and recorded in Marshall County Deed Book 899, at page 372.
The above described parcel of land is subject to that part of the right of way for both Irish Ridge Road and the aforesaid private roadway that are included within its boundary lines.
The above described parcel of land is subject to any and all exceptions, reservations, conditions or stipulations that are contained in or referred to in this deed and all prior deeds of record and also to any and all rights of ways or easements of record.
NOTE: This foreclosure sale was Noticed by publication on April 4, 2022 and April 11, 2022, for sale on the 19th day of April, 2022; which sale was continued until the 17th day of May, 2022, and further continued to the 22nd day of June, 2022, at 10:30 o’clock A.M., at the front door of the Marshall County Courthouse, Moundsville, West Virginia, per this Notice of Sale.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
