NOTICE OF TRUSTEE’S SALE Under authority of that certain Deed of Trust dated March 25, 2015, from Larry Wayne Harper and Cathleen Larose Harper to Marc B. Lazenby, Trustee, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book No. 4090, at page 931, securing a promissory note in the principal amount of $99,909.04, payable to Vanderbilt Mortgage and Finance, Inc., and default having been made under the promissory note secured by the aforesaid Deed of Trust and sale requested by Vanderbilt Mortgage and Finance, Inc., the undersigned Trustee will offer for sale at the front door of the Kanawha County Courthouse in Charleston, West Virginia on August 5, 2022 at 9:15 a.m., subject to all reservations, exceptions, easements and other matters which appear of record, and subject to all unpaid taxes, if any, the surface only of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Turkey Fork of Indiana Creek in Elk District, Kanawha County, West Virginia and being more particularly bound and described as follows: BEGINNING at a 1″ pipe found on the hillside said pipe being a common corner with the 7.38 acre tract conveyed to Glenden Major Proctor and Drema D. Proctor, his wife, by deed dated August 31, 1988, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2210, at page 786; thence with the outside line of the tract conveyed to Harold S. Proctor and Alla M. Proctor, his wife, by deed dated May 20, 1977, of record in the aforesaid Clerk’s Office in Deed Book 1829, at page 463, N. 65DEGREES 46′ W. 384.53 feet to a 1″ pipe found on the hillside; thence down the hill N. 11DEGREES 15′ E. 768.10 feet to a ONE-HALF” pipe found in a drain; thence out the hill S. 68DEGREES 59′ E. 541.10 feet to a ONE-HALF” pipe found, said pipe also a corner with the Glenden Major Proctor tract; thence with the dividing lines S. 22DEGREES 15′ 41″ W. 259.78 feet to a power pole beside the road, and S. 23DEGREES 22′ W. 519.30 feet to the place of beginning, containing 8.17 acres as surveyed March 1989, by Contractors Layout Inc., and as shown upon a map attached to deed dated April 6, 1989, of record in the aforesaid Clerk’s Office in Deed Book 2222, at page 528. MULLINS and MARY S. MULLINS, Deed Book 2231, Page 878 Tax Map 39 Parcel 22, Situate on the waters of Turkey Fork of Indian Creek in the Elk District, Kanawha County, West Virginia. As shown on “Plat of Survey by Timothy L. Keely WV PS No. 972, dated March 11, 2015.” RICHARD K MULLINS AND MARY S MULLINS later conveyed Parcels out of their Tax Map 39 Parcel 22 being Parcels 22.2 22.3 22.4 and 22.5 with the intent that the Existing Twenty (20) Road Right of Way, known as Vickers Drive was to be used as Ingress and Egress for all these Parcels as shown on the aforesaid Survey Plat. Description of Centerline of said Right of Way through the residue parcel owned by RICHARD K. MULLINS and MARY S. MULLINS Deed Book 2231, Page 878 Tax Map 39 Parcel 22. Beginning at a point on the centerline at the end of the WVDOT maintained Secondary Route 521/80 Vickers Drive, thence with said centerline S 46 15-11 E 27.00′ to a point; thence S 66-55-45 E 67.00′ to a point at the western boundary of Tax Map 39 Parcel 22.3. This Right of Way area contains 0.043 Acre (1875 sq. ft), more or less.
