NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 11, 2016, executed by Borrower(s), Shane Brown, to Patrick K. Moore and Peter Richardson, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1316, at Page 223. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 197 Pine Tree Ln, Princeton, WV 24739. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 26, 2022, of record in the Clerk’s Office in Book 1441, Page 597. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

All of that certain tract or parcel of real estate designated as the remainder of Lot 108, Jo-Ho Estates, as shown on a map entitled `PLAT OF SURVEY SHOWING THE RESURVEY AND DIVISION OF LOT #108 – JOHO ESTATES (THE JASON & JENNIFER SCARBRO PROPERTY), BEING THE PROPERTY DESCRIBED IN D.B. 913 Pg. 703, SITUATION ON THE WATERS OF DAVES FORK, APPROX. 2.5 MI. EST OF PRINCETON, ON CEDAR LANE, EAST RIVER DIST., MERCER CO., WV., SCALE 1″=40`, SURVEYED 07/18/12 BY JOSEPH A FINK P.S., 414 THORN STREET, PRINCETON, WV 24740`, said plat recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 17001, and more fully bounded and described as follows:

BEGINNING at a 5/8″ steel rod in the western right-of-way line of Cedar Lane and in the common corner of Lot 109 of Jo-Ho Estates, the Mark A. & Janice C. Walkup property (D.B. 706 Pg. 20-Plat #6331 A & B) and Lot 108, the Jason & Jennifer Scarbro property (D.B. 913 Pg. 703 – Plat #6331 A & B); thence leaving the western right-of-way line of said Cedar Lane, and running through said Lot 108, the following two (2) courses and distances: S. 87deg. 48` 21″ W. 59.89 feet to a 5/8″ rebar with a cap; thence S. 76deg. 28` 48″ W. 87.39 feet to a 5/8″ steel rod disturbed in the line of the Donald W. Frazier property (D.B. 859 Pg. 744); thence leaving the common corner of said Lot 109, and running with the common line of said Frazier, the following course and distance: N. 09deg. 57` 14″ W. 225.08 feet to a 5/8″ rebar with a cap in the common corner of Lot 107, the Paula II. Elliott property (D.B. 805 Pg. 480 – Plat #6331 A & B); thence leaving the common line of said Frazier, and running with the common line of said Lot 107, the following course and distance: N. 74deg. 27` 32″ E. 141.34 feet to a 3/4″ steel pipe disturbed in the common corner of Lot 98, the Stephen B. & Lori Gibson Corner (D.B. 708 Pg. 388 – Plat #6331 A & B); thence leaving the common corner of said Lot 107, and running with the common line of said Lot 98, the following course and distance: S. 16deg. 29` 24″ E. 60.58 feet to a 5/8″ rebar in concrete in the common corner of Lot 99, the William A. Hatch and Sue Ellen Kidd property (D.B. 862 Pg. 437 – Plat #13178); thence leaving the common corner of said Lot 98, and running with the common line of said Lot 99, the following course and distance: S. 23deg. 04` 35″ E. 119.08 feet to a PK nail in a driveway, and in the northern right-of-way line of said Cedar Lane; thence running with the right-of-way line of said Cedar Lane, with a curve to the left, having the following chord and data: S. 22deg. 33` 37″ W. 56.28 feet having a radius of 40.00 feet to a 7/8″ rebar; thence continuing with the right-of-way line of said Cedar Lane, with a curve to the right, having the following chord and data: S. 17deg. 01` 05″ E. 18.01 feet having a radius of 125.26 feet to the point of BEGINNING, and containing 0.813 acres, more or less.
Being the same property conveyed to Shane Mitchell Brown by the Deed dated April 26, 2016 and recorded in Deed Book 1036 at Page 696 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
