The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 14, 2010, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1395 at Page 423, and in the Office of the Clerk of the County Commission of Marshall County in Deed of Trust Book 863 at Page 433, Robert C. Armstrong, Jr. and Pamela S. Armstrong did convey unto David J. Sims and Susan L. Petrella, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marshall County Courthouse, in Moundsville, West Virginia , on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Marshall County, and in the Wheeling District, Ohio County, West Virginia, and more particularly described as follows:
All that certain lot, tract, or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Marshall County West Virginia, near boundary line between Ohio and Marshall Counties, and more particularly described as follows, to-wit:
PARCEL NO. 1 – Marshall County
The following described lot or parcel of real estate situate in Marshall County, West Virginia, near the boundary line between Ohio and Marshall Counties, and more particularly described as follows, to-wit:
Lot Number One Hundred Three (103) as shown and designated on the Plat of Mozart Terrace Section Addition, which plat is recorded in the Office of the Clerk of the County Court of Marshall County, West Virginia, in Deed Book No. 114, Page 384, together with the buildings and improvements situated thereon and thereunto belonging, Subject, however, to the building line shown and established on said plat. There is excepted and reserved, however, all the coal underlying said lot.
This conveyance is also made subject to all reservations, exceptions, and conditions referred to and contained in all prior deeds for said lot.
PARCEL NO. 2 – Marshall County
The following described lot or parcel of real estate situate in Marshall County, West Virginia, near the boundary line between Ohio and Marshall Counties, and more particularly described as follows, to wit:
Lot Number 104 inclusive as shown and on the Plat of “Mozart Terrace Section Addition,” which plat is recorded in the Office of the Clerk of the County Court of Marshall County, West Virginia, in Deed Book No. 114, at Page 384, together with the building and improvements situated thereon and thereunto belonging. Subject, however, to the building line shown and established on said plat.
The coal underlying said lot is excepted and reserved and not hereby conveyed.
This conveyance is made subject to all exceptions, reservations, covenants, conditions, easements, and rights of way referred to or contained in this deed, any aforementioned deeds and all prior conveyances of record.
PARCEL NO. 3 – Ohio County
Those certain parcels or lots of land situate in Ritchie City (formerly Ritchie County) District, Ohio County, West Virginia, and being Lots numbered 46, 47, 48, and 49 as the same are shown and designated upon the Plat of “Mozart Terrace Second Addition,” which said Plat is of record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book No. 1, at Page 149, subject, however, to the building line which is shown and established on said Plat. The coal underlying said property is excepted and reserved and not hereby conveyed.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 103 Lower Incline Avenue, Wheeling, WV 26003.
AND BEING the same real estate which was conveyed to Robert C. Armstrong, Jr. and Pamela S. Armstrong, by Deed dated April 23, 2007, from Fannie Mae AKA Federal National Mortgage Association, and recorded in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 660 at Page 289, and recorded in the Office of the Clerk of the County Commission of Ohio County in Deed Book 777 at Page 447.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
