TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 27, 2019, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 4370, at Page 823, Roy C Stover, II and Carol Sue Hambrick did convey unto Douglas B. Ernest and Charles J. Mildren, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by CITIZENS BANK NA f RBS CITIZENS NA to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on September 13, 2022 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 18 – Spring Hill District, Kanawha County, West Virginia, and more particularly described as follows: all of that certain parcel of land, together with the improvements thereon and appurtenances thereunto belonging, situate in Jefferson District, Kanawha County. West Virginia , being all of Lot Number One Hundred Ninety-eight (198) and part of Lot Number One Hundred Ninety-seven (197) as said lots are shown on that certain map entitled “Armor View Addition Jefferson District, Kanawha County, West Virginia”, dated July, 1917, made by Clarke & Krebs. C & M Engineers, and of record in the office of the Clerk of the County Commission of Kanawha County. West Virginia, in Photostatic Map Book 3 at page 51; which said lot One Hundred Ninety-eight (198) and part of Lot One Hundred Ninety-seven (197) are adjoining and together form one parcel of land more particularly described as follows: BEGINNING at a point in the easterly right of way line of Bridgeview Drive, formerly Walker Avenue, which point of beginning is the common corner shared by Lots 198 and 204: thence from said point of beginning and with the northeasterly boundary line of said Lot 198, S. 64DEGREES 25′ E. 166.6 feel to the common corner shared by Lots 198 and 199 in the westerly right of way line of Thomas Avenue: thence with the westerly right of way line of Thomas Avenue. S. 25DEGREES 35′ W . 70.3 feet to a point: thence leaving Thomas Avenue and running through Lot 197, N. 58DEGREES 21′ W. 142.2 feet to a point in the easterly right of way line of Bridgeview Drive; thence with the easterly right of way line of Bridgeview Drive. N. 1DEGREES 2′ E., passing the westerly common corner of Lots 197 and 198 at 20.25 feet, in all 60.75 feet to the point of beginning. This conveyance is made subject to all the reservations, restrictions, covenants, condition, provisions, easements and rights of way as found in prior deed in the chain of title. And being the same property conveyed unto Roy C. Stover and Wanda L. Stover by deed dated August 17. 1970 from Waller Donald Evans. Jr. and Mary G. Evans of record in the aforesaid Clerk’s office in Deed Book 1599, at page 596. The said Wanda L. Stover died on January 24, 2005, and by virtue of manner in which title was held, Roy C. Stover became the owner of said property herein conveyed. Said Roy C. Stover died testate on July 2, 2009 and devised the subject property to Roy Clinton Stover. II, by will dated December 2, 1969 and recorded in the aforesaid Clerk’s office in Will Book 803, at Page 868. And being the same property conveyed unto Roy Clinton Stover. II and Carol Sue Hambrick by deed dated December 10, 2009 from Roy Clinton Stover, II of record in the aforesaid Clerk ‘s office in Deed Book 2759, at page 357. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 100 Bridgeview Dr, South Charleston, WV 25309. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
