TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 30, 2003, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5011, at Page 1132, Herbert N. Bellamy a/k/a Herbert M. Bellamy and Gertrude Bellamy did convey unto Ed Goldberg, Trustee, certain real property described in said Deed of Trust; Douglas Lee Bellamy and Tammy Bellamy modified and assumed said loan by Loan Assumption in Deed of Trust Book 5069, at Page 9333 and by Loan Modification in Deed of Trust Book 5069, at Page 9334; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Town District, Raleigh County, West Virginia, and more particularly described as follows:

ALL THAT CERTAIN PARCEL OF LAND SITUATE IN THE CITY OF PROSPERITY, COUNTY OF RALEIGH AND STATE OF WEST VIRGINIA, TO WIT:
A PART OF LOT NO. 4 OF THE JOE F. WRIGHT HEIRS PROPERTY, LOCATED AT PROSPERITY, IN TOWN DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, A MAP OF WHICH SAID JOE F. WRIGHT HEIRS PROPERTY IS RECORDED IN THE AFORESAID CLERK’S OFFICE IN DEED BOOK 400, AT PAGE 441, AND THE PROPERTY HEREBY CONVEYED IS MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS:
BEGINNING AT A STAKE ON OLD U.S. 19-21, THE COMMON CORNER OF LOTS 3 AND 4 OF THE JOE F. WRIGHT HEIRS PROPERY; THENCE WITH THE OLD U.S. 19-21, N. 56 DEGREES 17′ E. 131 FEET TO A STAKE AT THE INTERSECTION OF THE OLD U.S. 19-21 AND A 19-FOOT STREET; THENCE WITH SAID 19-FOOT STREET, S. 34 DEGREES 06′ E. 30 FEET, MORE OR LESS, TO A STAKE AT THE INTERSECTION OF SAID 19-FOOT STREET AND A 20-FOOT STREET; THENCE WITH THE 20-FOOT STREET, S. 55 DEGREES 54′ W. 25 FEET TO A STAKE IN THE COMMON LINE OF LOTS 3 AND 4; THENCE WITH THE COMMON LINE OF LOTS 3 AND 4, N. 53 DEGREES 05′ W. 318 FEET TO THE POINT OF BEGINNING.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 604 Prosperity Road, Prosperity, WV 25909.

AND BEING the same real estate which was conveyed to Herbert N. Bellamy a/k/a Herbert M. Bellamy and Gertrude Bellamy by Deed dated June 5, 1962, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 413, at Page 229.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
