The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 14, 2011, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5045, at Page 204, Fallon K. Vandall did convey unto Vance Golden, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
September 13, 2022, at 1:36 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beckley District, Raleigh County, West Virginia, and more particularly described as follows:
Part Lots 2 and 3 of the BRAMMER ADDITION in the City of Beckley, Raleigh County, West Virginia, a copy of the map of said addition being of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia, in Deed Book 229, at Page 79, the said part of lots being more particularly bounded and described as follows:
Beginning at a stake on the western line of North Vance Drive (formerly Johnstown Road), the common corner of Lots 1 and 2 of the Brammer Addition; thence with the common line of the aforesaid lots S. 68deg. 35′ W. 123 feet to a stake in that same common line; thence across and through the full width of said Lot 2 and continuing in the same line through20 feet of Part of Lot 3 of said Addition N. 21deg. 24′ W. 70 feet to a stake in the common dividing line of the property of the parties of the first part and Coy Fugate, which common line divides the said Lot 3 between them; thence with this said common line N. 68deg. 35′ E. 123 feet to a stake on the western line of North Vance Drive; thence with the said western line of Vance Drive S. 21deg. 25′ E. 70 feet to the place of beginning, containing 8,610 square feet, more or less, and being a tract 123 feet deep fronting 70 feet on North Vance Drive, consisting of a part of Lot 2 and a part of a 20 foot strip of Lot 3 of the BRAMMER ADDITION.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 437 North Vance Drive, Beckley, WV 25801.
AND BEING the same real estate which was conveyed to Fallon K. Vandall by Deed dated November 8, 2011, from Homer Mullins, Robert Mullins, Juanita Sims, Annabelle Rayle, Sally Crabtree and Helen V. Vass, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5045, at Page 202.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
