May 26, 2022 and May 31, 2022.
On or about May 26, 2022 and May 31, 2022, Corporal J.M. Tallman, of the Mountain Region Drug and Violent Crimes Task Force and Corporal D. Sayre of the Elkins Police Department conducted an investigation regarding Joshua E. Cave committing the offense of Possession With Intent to Deliver a Controlled Substance, pursuant to W. Va. Code section 60A-4-401(a)(i) and, pursuant to that investigation, seized $4,990.00 in United States Currency and the above described firearms. Said property was found in the actual or constructive possession of Joshua E. Cave.
On the 26th day of May, 2022, during a traffic stop performed in Randolph County, West Virginia, Corporal D. Sayre found and seized numerous items including $990.00 in United States Currency. On the 26th day of May, 2022, during a search, pursuant to a warrant, conducted by Corporal J.M. Tallman and other officers on Unit 2011 of the U-Haul storage facility located at 271 Valley Point Drive, Elkins, WV, leased by Joshua E. Cave, found and seized numerous items including $4,000.00 in United States Currency. On the 26th day of May, 2022, during a search, pursuant to a warrant, conducted by Corporal J.M. Tallman and other officers of the residence of Joshua E. Cave, located at 82 Jackson Avenue, Elkins, WV, found and seized numerous items including one (1) Remington Wood Master Model 742 30-06 Firearm (Serial #B6969902).
On the 31st day of May, 2022, during a search, pursuant to a warrant, conducted by Corporal J.M. Tallman and other officers, of Unit 55 of A-1 Self Storage Facility located at 100 Haney Street, Elkins, WV, used under the direction of Joshua E. Cave, found and seized numerous items including five (5) firearms, specifically, one (1) Rock Island Armory M1911a1 .45 Firearm (Serial #Ria1875289), one (1) Ruger Sr-9 9mm Firearm (Serial #331-68749), one (1) Winchester 670-a .243 Firearm (Serial # G171316), one (1) Winchester model 94 30wcg .30 Caliber Firearm (Serial # 1536964) and one (1) Mossberg 500 At-12 Gauge Shotgun Firearm (Serial# G783065).
The Petitioners believe that the said $4,990.00 in United States Currency and the above described firearms are subject to seizure and forfeiture, pursuant to the West Virginia Contraband Forfeiture Act (W. Va. Code sections 60A-7-703 and 704), and that said $4,990.00 in United States Currency and the above described firearms were used to facilitate the sale, receipt, possession, manufacturing, possession with intent to deliver, and/or delivery of controlled substances in violation of Chapter 60A of the Code of West Virginia.
Petitioners seek an Order from the Circuit Court of Randolph County, West Virginia that the said $4,990.00 in United States Currency and the above described firearms be forfeited to the State of West Virginia and ownership of said property be vested in the State of West Virginia; that, thereafter, it be disposed of according to law.
Any claimant to the above referenced property being $4,990.00 in United States Currency and the above described firearms has a right to file a claim on or before October 4, 2022. Any claim must clearly state the identity of the claimant and an address where legal process can be served upon them and must be filed with the Circuit Clerk of Randolph County, West Virginia.
