TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 28, 2020, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 4421, at Page 694, Randy T Whittington and Trish Whittington did convey unto Andrew Skinner, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by WILMINGTON SAVINGS FUND SOCIETY, FSB, AS TRUSTEE OF STANWICH MORTGAGE LOAN TRUST M to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on November 29, 2022 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 19 – Loudon District, Kanawha County, West Virginia, and more particularly described as follows: All the following described real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Chappell Hollow and Cane Fork of Davis Creek in Loudon District, Kanawha County, West Virginia, and more particularly described as follows: BEGINNING at a Roof Bolt (set) referenced S. 44 47′ 30″ W. 308.83 feet from a ONE-HALF inch pipe (found) in the original tract; thence N. 61 49′ 16″ E. 194.14 feet to a Roof Bolt (set) referenced S. 59 38′ 07″ W. 489.21 feet from a Set Stone (found), 2 inch pipe called for in the original tract; thence S. 22 53′ 20″ E. 456.73 feet to a Roof Bolt (set); thence S. 68 58′ 36″ W. 315.28 feet to a Roof Bolt (set); thence N. 07 01′ 24″ W. 445.54 feet to the point of beginning, containing 2.578 acres, more or less and being further described on the plat prepared by James L. Young and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2533, at page 894. And for the consideration aforesaid, the parties of the first part do further hereby GRANT and CONVEY unto the parties of the second part, an easement and right-of-way ten (10) feet in width and lying on the route of the existing driveway from West Virginia Route #38 to the house built on the 2.578 Acre Tract described above, said right-of-way and easement running on, over, across, under and through the land now or previously owned by Walter Huffman and Virginia Huffman, situate on the Waters of Chappell Hollow and Cane Fork of Davis Creek in Loudon District, Kanawha County, West Virginia, as shown upon that certain Map dated April, 1996 and recorded in Deed Book 2392, at page 112, said easement and right-of-way having been conveyed by Walter Huffman and Virginia Huffman, his wife, to Brett Wayne Childress and Season Terry Childress, his wife, by instrument dated March 11, 1999, and recorded in the aforesaid Clerk’s Office in Deed Book 2464, at page 286. And being the same property conveyed unto Samantha B. Burgess and Paul A. Burgess by Bradley S. Persinger by deed dated June 27, 2017, of recorded in the aforesaid Clerk’s Office in Deed Book 2977, at page 867. And also being the same property conveyed unto Samantha B. Burgess by Paul A. Burgess by deed dated April 21, 2020 to be recorded immediately prior hereto in the aforesaid Clerk’s Office; and being also the same property conveyed unto Randy T. Whittington by Samantha B. Burgess by deed dated April 28, 2020 to be recorded simultaneously herewith in the aforesaid Clerk’s Office. This conveyance is made subject to any and all covenants, restrictions, and easements as the same may appear in instruments of record in the aforesaid Clerk’s Office. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 3018 Cane Fork Road, Charleston, WV 25314. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
