NOTICE OF TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned, J. Nicholas Barth, Successor Trustee, by that certain Deed of Trust made by Carolyn Sue McLaughlin to P. Michael Pleska and F. Thomas Graff, Jr., Trustees, bearing date November 27, 2006, and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Trust Deed Book 3419 at page 860; the said J. Nicholas Barth acting as Successor Trustee by virtue of that certain Appointment of Successor Trustee dated the 27th day of November, 2006, of record in the aforesaid Clerk’s Office in Trust Deed Book 4481 at page 81; and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, the undersigned Successor Trustee will offer for sale, at public auction, to the highest bidder at the North Front Door of the Courthouse of Kanawha County, West Virginia, in the City of Charleston, West Virginia, on Wednesday, the 9th day of November, 2022, at 10:00 o’clock a.m., all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on Martins Branch, Union District, Kanawha County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEGINNING at an iron pin in the easterly line of a 30 foot right of way, which is described in that certain right of way Agreement made by Alice Bertha Legg and M. H. Leonard et al, dated May 20, 1960, and of record in the Office of the Clerk of the County commission in Deed Book 1310, at page 740, and which iron pin is located at the corner of the Daniels parcel; thence running with the eastern line of said right of way, N. 16 14′ W. 172.9 feet to a stake; thence continuing with said eastern line of said right of way, N 37 W. 31 feet to an iron pin: thence N. 77 41′ E. 415 feet to a stake in the outside boundary line of the K. E. Legg Farm; thence S. 18 20′ E. 201 feet to a iron pin at the rear corner of the Daniels lot; thence with the line of the Daniels line, S. 77 41′ W. 408 feet to the place of beginning, together with the right to use jointly with others for purposes of ingress and egress, the use of the aforesaid 30 foot right of way. And being the same property conveyed to Maurice Neal McLaughlin and Carolyn Sue McLaughlin by Emory Hopkins and Nettie V. Hopkins, by deed dated February 9, 1967, and of record in Deed Book 1401 at page 519. Said property having address of 818 Pioneer Lane, Charleston, WV 25312. The referenced property will be conveyed with covenants of special warranty subject to all further covenants, conditions, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground. TERMS OF SALE: Cash in hand at time of sale, subject to all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. Pursuant to the terms of the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
