The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated August 20, 2004, and duly recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed of Trust Book 384, at Page 711, Ronald B. Pingley did convey unto Thomas R. Ross, II, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Richard A. Pill as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

All that certain tract or parcel of real estate situate 0.2 miles east of the Ward Road on a private road and 1.6 miles south of the Scott Ford Bridge lying in Beverly District, Randolph County, West Virginia, more particularly bounded and described as follows:

Beginning at a point at the east base of a clump of small maples, 21′ southeast of said private road and 12 northwest of a drain, a corner to Mildred Goldberg (WB 18/3) and a corner in line of Frances L. Wileman (DB 275/510), set a 3/4″ x 42″ rebar with plastic cap, from which a 13″ white oak, in said drain, bears S. 41 00 E. 11.9′ and a 1″ iron pipe, found, at the thorn corner called for in the Higgins deed, bears S. 56 45 W. 621.37′, thence with said Wileman for three lines

BEGINNING at a 3/4″ × 42″ iron rebar (found), being a corner to Phillip Howell’s 2.04 acre tract (455/802), and being a corner to John Smith Jr’s 2.20 acre tract (438/466), and being in the. line of Homer Wiseman’s 6.8 acre tract (459/659), thence leaving said 2.20 acre tract and with said 2.04 acre tract and said 6.8 acre tract

N 64 17 45 E 66.00 feet to a 20″ Hickory Tree (found), being a corner to said 2.04 acre tract and said 6.8 acre tract, thence with said 2.04 acre tract and said 6.8 acre tract

N 54 06 00 W 106.00 feet to the beginning, containing 0.328 acres, more or less, as surveyed by Robert A. Kitzmiller, P.S. #635 of Buckhannon, West Virginia.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Ward Road, Elkins, WV 26241. We have reason to believe the property has a current mailing address of 130 Little Beagle Lane, Elkins, WV 26241. PLEASE NOTE: Property is being sold based on the legal description, not the address. Prospective purchasers should verify prior to bidding at the sale.

AND BEING the same real estate which was conveyed to Ronald B. Pingley by Deed dated August 20, 2004, from Phillip L. Howell, and recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 498, at Page 113.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
