Notice is hereby given that the undersigned Substitute Trustee, appointed by document dated September 23, 2022, and of record in the Office of the Clerk of the Ohio County Commission in Deed of Trust Book 1664, at page 317, will sell at public auction to the highest bidder on:
November 11, 2022, at 10:00 a.m.
at the front door of the Ohio County Courthouse, 1500 Chapline Street, Wheeling, West Virginia, that certain property conveyed by Jeffery A. Ebbert, Jr., and Crystal A. Ebbert and David E. Richards, to Ronal W. Rush, Original Trustee, by Deed of Trust dated November 28, 2016, and recorded in the office of the said Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1535, at page 712, and being described as follows:
A tract of real estate situated in Triadelphia District, Ohio County, West Virginia, more particularly bounded and described as follows:
Beginning at a point, designated as a post on the Amended Plat of Simms and Nesbitt’s Addition, as recorded in Plat Book 2, Page 47, of the Ohio County records, said point being in the division line between Front Street and Croser Road (aka Kruser Road), thence with the easterly lines of said road N. 41 degrees 28′ E. 19.70 feet to a point, thence N. 45 degrees 51′ E. 113.27 feet to a point, thence N. 42 degrees 43′ E. 103.99 feet to an iron pin, thence N. 31 degrees 16′ E. 19.30 feet to a railroad spike, thence leaving said road and running through a 6.17 acre tract of Pagano (Deed Book 674, Page 222) N. 87 degrees 15′ 55″ 29.64 feet to an iron pin, thence S. 45 degrees 05′ 28″ E. 87.96 feet to an iron pen, thence S. 09 degrees 44′ 49″ W. 243.02 feet to an iron pen thence 63 degrees 33′ 28″ W. 215.40 feet to an iron pin at the most northerly corner of Lot 39 as shown on said plat of Simms and Nesbitt’s Addition, thence with the northerly line of said Front Street N. 61 degrees 36′ 12″ W. 37.26 feet to the place of beginning, containing 1.001 acres, more or less, according to a survey by Chadan Engineering, Inc., in June, 2007.
The above described tract is subject to a 20 foot right of way along its northerly boundary (N. 87 degrees 15′ 55″ E) for ingress, egress and utilities, to and from the lands remaining to Pagano.
There is granted unto the party(ies) of the second part, hereto, the right to use aforesaid Kruser Hill Road leading from Elmer Street to the residence presently located on the subject property.
Being the same property conveyed to Jeffery A. Ebbert, Jr., and Crystal A. Ebbert, husband and wife, by Julius L. Demasi and Regina R. Demasi, husband and wife, by Deed dated October 28, 2016, and recorded in Ohio County Deed Book 912, at page 395.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record if any pertaining to said real estate; (2) any and all unpaid taxes assessed against said property; (3) the subject property will be sold in “as is” condition; (4) the Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property; (5) the Substitute Trustee will deliver a Substitute Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Substitute Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120-day redemption period pursuant to 26 U.S.C.A. section7424(d).
