CITY OF BECKLEY
PUBLIC NOTICE OF HEARING
Notice is hereby given, that the City of Beckley will hold, in compliance with Rule 3.6.1 of the Cable Television Rules issued by the Public Service Commission of West Virginia (“Cable Rules”), a public hearing regarding the issue of renewal of the Cable Franchise Agreement with Cequel III Communications II, LLC doing business as Optimum (“Optimum”). Said hearing will constitute an Administrative Proceeding under the Cable Rules.
The hearing will be held on December 13, 2022, at 5:30 p.m., in the City Council Chambers, City Hall, Beckley, West Virginia. Any interested parties may appear at the hearing and be heard with respect to the renewal issue.
The purpose of the hearing will be to consider whether the renewal should be granted based upon whether:

1. Optimum has substantially complied with the material terms of its most recent franchise and with applicable law;
2. The quality of Optimum’s service, including signal quality, response to consumer complaints, and billing practices has been reasonable in light of community needs;
3. Optimum has the financial, legal and technical ability to provide the services, facilities, and equipment as set forth in its application for renewal; and
4. Optimum’s proposal is reasonable to meet the future cable-related community needs and interests, taking into account the costs of meeting such needs and interests.
A copy of the Application for Renewal is available for public inspection at the Office of the Mayor of the City of Beckley, City Hall, Beckley, West Virginia, during normal weekday business hours of 8:30 a.m. to 4:30 p.m.
