TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 19, 2004, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 3113, at Page 948 and modified in a Loan Modification Agreement dated March 8, 2010, in Book No. 3714, at Page 938, Mark Huffman and Lona Huffman did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank Trust National Association, not in its individual capacity, but solely as Owner Trustee on behalf for Citigroup Mortgage Loan Trust 2021-RP4 to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on December 27, 2022 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 15 – Elk District, Kanawha County, West Virginia, and more particularly described as follows: All that certain tract or parcel of land, together with any improvments thereon and appurtenances thereunto belonging, situate on the waters of Aaron’s Fork, Elk District, Kanawha County, West Virginia, being more particularly described as follows: Beginning at an iron pin in the line of Charles Reed, said iron pin being located N. 80 deg. 12′ E. 206.58 feet from an “X” on a rock cut on the East side of West Virginia Local Service Route No. 39, a small white oak witness bears N. 22 deg. 05′ E. 2.88 feet; thence with Reed’s line, N. 80 deg. 12′ E. 140.39 feet passing a corner between Reed and Cora Hughart; thence continuing wiht Hughart’s line to an iron pin; thence leaving Hughart’s line and through the land of Kenneth and Peggy L. Wolfe of which this was a part, S. 17 deg. 55′ E. 171.88 feet to an iron pin, an eight (8) inch white oak witness bears N. 50 deg. 16′ E. 15.70 feet and a five (5) inch hickory bears N. 80 deg. 45′ E. 12.80 feet; thence S. 89 deg. 45′ W. 106.43 feet to an iron pin, an eight (8) inch hickory bears N. 28 deg. 22′ W. 18.10 feet and a twelve (12) inch hickory bears S. 51 deg. 42′ W. 14.55 feet; thence N. 31 deg. 11′ W. 163.73 feet to the place of beginning, and containing 0.46 acre, more or less, as shown upon a map entitled “Map Showing Lot to be Conveyed to William M. Burdette Aarons Fork of Little sandy Creek elk dist. Kanawha Co. W.Va.” dated February 17, 1973, made by C.T. Tolley, Jr., and attached to that certain deed dated March 26, 1973, from Kenneth Wolfe and Peggy L. Wolfe, his wife, to William Michael Burdette and Pamela Sue Burdette, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1694 at Page 46, and incorporated herein by reference fro a more particular description of the property herein conveyed. Being the same property conveyed unto Mark Huffman and Lona Huffman, his wife, from Janet S. Cummings, single, by deed dated the 30th day of June, 2003, and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book No. 2579, at Page No. 728. Further being the same property conveyed unto the parties of the first part by William Michael Burdette and Pamela Sue Burdette, his wife, by deed dated the 10th day of May, 1985, and recorded in the office of the County Commission of Kanawha County, West Virginia, in Deed Book 2096, at Page 196. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 71 Brian Lane, Elkview, WV 25071. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
