ORDER OF PUBLICATION AGAINST GARY ALLMON II PLEASE TAKE NOTICE that an action has been filed in the United States District Court for the Southern District of West Virginia, styled Truist Bank, formerly Branch Banking and Trust Company, a North Carolina banking corporation, v. Gary Allmon II, Civil Action No. 2:22-cv-00361. The object of the action is to recover damages for the alleged breach of three contracts under the laws of the State of West Virginia. Plaintiff in this action is represented by Tai Shadrick Kluemper of Spilman Thomas & Battle, PLLC. She can be reached at 300 Kanawha Boulevard East, Charleston, West Virginia 25301. A copy of the Verified Complaint in this action may be obtained from the Court Clerk at the Robert C. Byrd United States Courthouse, 300 Virginia Street, East, Suite 2400, Charleston, WV 25301. Defendant Gary Allmon II must file his answer or other defense to the Complaint on or before, January 31, 2023; which is not fewer than 30 days after the first publication of the Order; otherwise, judgment by default will be taken against him at any time thereafter. It is further ORDERED that the Plaintiff cause this Order to be published in the Charleston Gazette-Mail, a newspaper of general circulation published in Kanawha County, West Virginia, where this civil action is pending and where the last known address for Mr. Allmon is located, once a week for at least two successive weeks. The first publication shall take place no later than December 30, 2022. The Court DIRECTS the Clerk to send a copy of this Order to counsel of record and to any unrepresented party.
