Notice is hereby given that Panther Creek Mining, LLC, 250 W. Main Street, Suite 2000, Lexington, KY 40507 has submitted an application with the Department of Environmental Protection (DEP), division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for an Article 3 permit for the surface disturbance of approximately 49.11 acres in order to surface mine using the contour and area mining methods. The approved acreage is 667.25 acres and the proposed acreage for this Amendment application is 49.11, for a new total acreage of 716.36 in the Upper Clarion, Lower Clarion, Stockton A, Stockton, Coalburg, Lower Coalburg, Upper Winifrede2, Upper Winifrede 1, Lower Winifrede, Chilton Rider, Chilton, Chilton Leader Rider, Chilton Leader, and all splits and riders of all seams of coal. The proposed operation is discharging into Unnamed Tributary of/and Toms Branch of Paint Creek of Kanawha River and is located 2.50 miles southwest of Powellton in the Cabin Creek and Valley Districts of Kanawha and Fayette Counties, Longitude 81deg. 21′ 38″ Latitude 38deg. 04′ 02″.
