Rutherford, Sheriff of Kanawha County, West Virginia (hereinafter sometimes referred to as “the aforementioned respondents”), that a Petition for Condemnation ight of Entry has been filed in the Circuit Court of Kanawha County, West Virginia, and is known as Civil Action No. 22-P-366, and styled Appalachian Power Company vs. Crider Family Trust, et al. Said Petition for Condemnation ight of Entry under the West Virginia laws of eminent domain seeks property for the construction of electrical transmission, distribution, and communication lines and appurtenant equipment and fixtures, and condemnation and right of entry on behalf of Appalachian Power Company situate on WV State Route 61 and being on the waters of the Kanawha River, in the Town of Marmet, in Marmet District, Kanawha County, West Virginia, identified as Tax Map 8, Parcel 97.1, and recorded in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 3116, at page 601, and being more specifically bounded and described as follows: Beginning at a 51/3″ rebar set in the northern right of way line of WV State Route 61 and a corner to Parcel B of this survey, said rebar be in the western line of an access easement; thence, N 24DEGREES 06 29 W, 15.23′, with said Route 61 right of way line to a point; Thence, N 40DEGREES 15 00 W, 59.21 , with same to a point; thence, N 48DEGREES 50 10 W, 58.11 , with same to a point; thence, N 58DEGREES 23 10 W, 58.04 , with same to a point; thence, N 67DEGREES 58 10 W, 57.95 with same to a point; thence , N 76DEGREES 33 10 W, 58.04′, with same to a point; thence, N 87DEGREES 06 10 W, 58.11′, with same to a point; thence S 86DEGREES 10 10 W, 40.77′, with same to a point; thence, S 80DEGREES 22 00 W. 7.80 , with same to a ONE-HALF” rebar being a corner to H & J’s Land deed book 2539, Page 645; thence N 61DEGREES 45 00 E, 367.49 , with said H & J’s line passing a corner to Appalachian Power, deed book 1068, page 130, and continuing with same to a 1/2″ rebar found; Thence, N 61DEGREES 45 00 E, 35.77′, with same to a point at the low water mark of the Kanawha River; thence, S 27DEGREES 29 50 E, 162.95 , with said river to a point; thence, S 32DEGREES 59 50 E, 157.34 , with same to a point a corner to said Parcel B; thence, S 63DEGREES 37 36 W, 165.36, with said Parcel B passing over a 51/3 rebar set a 35.56 , being a corner to said access easement and continuing with same an additional 130.00 to a 51/3″ rebar set; thence, S 85DEGREES 24 43 W, 13.76′, with same to the point of beginning and containing 1.71 acres. The aforementioned respondents are hereby notified a copy of said Petition for Condemnation ight of Entry may be obtained from the Kanawha County Circuit Clerk’s office at 111 Court Street, Charleston, West Virginia, 25301, for the purposes of appearing and defending. The Petition for Condemnation ight of Entry may also be obtained from the attorneys for Appalachian Power Company, Stephen F. The aforementioned respondents are further notified that a hearing on the said Petition for Condemnation ight of Entry will occur on January 31, 2023, at 10:45 a.m., in the Circuit Court of Kanawha County, West Virginia, located at 111 Court Street, Charleston, West Virginia, 25301, before the Honorable Carrie L. Webster. You may appear for hearing as stated above, and are notified that any failure to appear may result in the waiver of any defenses or claims, if any, you may have.
