NOTICE OF SALE
Under authority of a certain Deed of Trust dated May 27, 2010, from Trellis A. Moore and Joan C. Moore to J. Gregory Gency, Michael W. Asbury, Jr. and Fred A. Jesser, Trustees, securing Clay County Bank, Inc., a West Virginia corporation, in the amount of $59,115.56, of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 859, at page 659, default having been made in the payment of the obligation secured by said Deed of Trust, and sale having been requested in writing by the holder of the indebtedness secured, the undersigned, Raymond G. Dodson, Substitute Trustee, by virtue of Appointment of Successor Trustee dated November 21, 2022 and recorded in the aforesaid Clerk’s Office in Book 1075, at page 453, will offer for sale at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on February 14, 2023, at 10:00 o’clock, the certain real estate conveyed in said Deed of Trust, bounded and described as follows:
All that certain surface tract of parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Plateau District, Fayette County, West Virginia, which property is more particularly bounded and described as follows:
Beginning at a steel pin, said pin being the most northern corner of this land with Lot 5 adjacent and the Binford Lane; thence leaving said Lot 5 and running with the Binford Land N 81deg.45′ E 125 feet to a steel pipe; thence leaving the Binford Lane and running into the Everette Bishop Land of which this new conveyance is a part, S 8deg.00′ E 284.06 feet to a steel pipe; thence S 81deg.45′ W 125 feet to a steel pipe, said pipe being the dividing line between Lot 5 and Lot 6, Lot 6 being the Everette Bishop Land; thence running with the said division line N 8deg.00′ W 284.06 feet to the point of beginning, containing 0.81 acre, more or less.
Being the same property conveyed unto Trellis A. Moore and Joan C. Moore by that certain survivorship deed dated March 27, 2010, from R. Vance Golden, III, of record in the office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 659, at page 518.
Trellis A. Moore died on or about April 11, 2016, and pursuant to the survivorship clause contained in aforesaid deed, Joan C. Moore became the sole owner thereof.
The said Joan C. Moore died on or about December 31, 2021, and pursuant to her Last Will and Testament of record in the aforesaid Clerk’s Office in Will Book 95, at page 593, her children Timothy Wayne Moore, Tamara Lynn Murphy, Teresa Denise Shaffer and Tina Renae Gray inherited the same. According to an Affidavit filed in the aforesaid Clerk’s Office in Book 179, at page 462, the said Teresa Denise Shaffer died on or about July 23, 2021, with Candace Gray, Liann Millikan, Hannah Dobbs and Alyssa Shaffer being her issue.
This conveyance will also be made subject to any and all reservations, exceptions, restrictions, rights of way and easements contained in prior deeds affecting said property of record in said Clerk’s office or visible on the ground.
This property will be conveyed by Trustee together with the hereditaments thereof and all building, structures and improvements now or hereafter situate thereon and all fixtures, materials, supplies, equipment, machinery and other property as is now or may hereafter be an accession thereto, be a fixture thereto, or be otherwise treated or deemed as a part of the land described herein, all of which is included in the term “property” as used herein. By way of example and not by way of limitation, such fixtures and accessions shall include heating, cooling and air-conditioning units, plumbing and electrical fixtures and equipment, built-in appliances of every kind, boilers, machinery, motors, wall-to-wall carpeting, storm doors and windows, awnings and all furnishings attached to the property.
The above-described real estate will be conveyed by the undersigned Trustee to the purchaser by deed containing a Covenant of Special Warranty and subject to all liens, reservations and exceptions appearing in the record of title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid deed of trust. Purchaser must pay all transfer taxes, delinquent or current real estate taxes, title search and any costs related to recording of any Deed from the Trustee herein.
TERMS OF SALE
Any successful bidder shall pay 10% of the sales price as a deposit in Certified Funds or Cash at the time of sale with the balance to be paid within 30 days from date of sale. The above-described real estate will be sold by the undersigned Trustee by auction to the highest bidder subject to the right of the Trustee to reject all bids if in his opinion they are inadequate. The owner of the indebtedness secured by the above-described deeds of trust and the owner of any other interest in the properties to be sold shall have the right to bid.
CONTINUANCE OR
ADJOURNMENT OF SALE
The Trustee reserves the right to continue the sale, or adjourn the sale for a time, or from time to time, and the place of sale, as hereinabove set forth, or any continuance or adjournment thereof.
