By virtue of that certain Deed of Trust made by Donald W. Dunaway to John E. Gompers, Trustee, dated the 21 st day of March, 2012, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1432, at page 431, and that certain Appointment of Successor Trustee, dated the 4 th day of January, 2023, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1668, at page 495, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 14th day of February, 2023, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, the following described property (“Property”) situate at 131 Rustic Pines, Wheeling, Ohio County, West Virginia 26003, and being more particularly described as follows:
All that certain parcel of land situate in Richland District, Ohio County, West Virginia, and being more particularly described as follows:
Beginning at a concrete monument found at the south west corner of Lot 5 and south east corner of Lot 6 of the subdivision of the Wilkinson Farm as on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 4 at page 11; said monument being in the line of the 13.155 acre tract of Monroe as on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 704 at page 368; thence with the line of the 13.155 acre tract and the rear of Lots 5, 4 and 3 south 64 degrees 29 minutes east 308.87 feet to a iron stake found at the corner of Lot 3 and corner of a .6154 acre tract as on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 524 at page 259 and corner of the .833 acre tract as on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 613 at page 714; thence with the division line of the 13.155 acre tract and the .833 acre tract south 00 degrees 59 minutes west 150 feet to a pipe set at the south west corner of the .833 acre tract and south east corner of the 13.155 acre tract; thence with the south line of the 13.155 acre tract and north line of the 102 acre tract as on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 714 at page 784 north 89 degrees 01 minutes west 615.26 feet to a pipe; thence through the 13.155 acre tract north 05 degrees 42 minutes 53 seconds west 448.15 feet to a pin found at the south west corner of a 4.815 acre tract as on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 621 at page 465 and at the south east corner of the 9 acre tract as on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 729 at page 619; thence with the division line of the 13.155 acre tract and the 4.815 acre tract south 88 degrees 52 minutes 40 seconds east 230.33 feet to an iron pin found at the corner of the 13.155 acre tract and in the west line of Lot 7 of said plan of lots; thence with the line of the 13.155 acre tract and the end of a 30 foot right of way as shown on said subdivision plan south 00 degrees 57 minutes 40 seconds west 15 feet to the center of said right of way; thence with the center of said 30 foot right of way and the division line of Lots 6 and 7 south 89 degrees 02 minutes 20 seconds east 156.15 feet to the corner of Lot 6 and 5; thence leaving said right of way and with the division line of Lots 5 and 6 south 00 degrees 57 minutes 40 seconds west 151.34 feet to the place of beginning containing 5 acres as determined by survey dated February 17, 2005 by Tri-State Surveying, Inc.
There is EXCEPTED and RESERVED from the above described property that certain 1.89 acre tract which was heretofore conveyed by Harry R. Myers, III and Stephanie K. Myers, husband and wife, to Mark Nardone and Susan Nardone, husband and wife, by a Deed dated the 11 th day of October, 2006, and recorded in the aforesaid County Clerk’s office in Deed Book No. 772, at page 329.
Subject to all easements, rights of way, and restrictions of record. This tract is connected to the Stone and Shannon Road by two 30 foot right of ways as shown on said subdivision plan.
Being the same property which was heretofore conveyed to Donald D. Dunaway by Harry R. Myers, III and Stephanie K. Myers, husband and wife, by a Deed dated the 15th day of March, 2012, and recorded in the aforesaid County Clerk’s office in Deed Book No. 835, at page 593.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable, and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Successor Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
