Activity:
To operate and maintain an existing combined wastewater collection system and an existing 10.0 million gallons per day wastewater treatment plant. These facilities are to serve a population equivalent of approximately 100,000 persons in the City of Wheeling, Bethlehem, Triadelphia, Clearview, Benwood, Ohio County PSD No. 1, and environs and discharge the treated wastewater via Outlet No. 001 to the Ohio River at Milepoint 91.2.
To operate and maintain disposal systems, best management practices, and the nine (9) minimum controls for the direct discharge of sanitary wastewater and storm water from 40 combined sewer system overflow relief points which discharge during wet weather events when the hydraulic capacity of the wastewater treatment plant is exceeded through Combined Sewer Overflow Outlet No. C007,C013, C016, C017, C037, C051, C054, C057, C058, C059, C061, C062, and C222 to the Ohio River; Combined Sewer Overflow Outlet Nos. C063, C074, C075, C091, C095, C099, C100, C101, C103, C106, C109, C111, C124, C129, C131, C132, C133, C134, and C221 to Wheeling Creek of the Ohio River, Combined Sewer Overflow Outlet Nos. C140 and C148 to Caldwell Run of the Ohio River, Combined Sewer Overflow Outlet Nos. C152, C157, and C159 to Little Wheeling Creek of Wheeling Creek of the Ohio River, Combined Sewer Overflow Outlet Nos. C163 and C165 to Long Run of Wood Run of Wheeling Creek of the Ohio River, Combined Sewer Overflow Outlet No. C141 to George Run of Caldwell Run of the Ohio River.
Also, to operate amd maintain an approved POTW Pretreatment Program. Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee’s facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell.
An antidegradation review has been conducted and Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6 for Outlet No. 001. Tier 1 protection shall be afforded for the wet weather discharges from the 42 Combined Sewer Outlets through the implementation of the facility’s CSO Long-Term Control Plan (LTCP).

Compliance with the final terms and conditions of this permit pertaining to CSO effluent discharges shall be attained through the implementation requirements of Administrative Order No. 5733 and all subsequent amendments and through the City’s CSO Long Term Control Plan (LTCP).

On the basis of review of the application, the “Water Pollution Control Act (Chapter 22, Article 11-8(a)),” and the “West Virginia Legislative Rules,” the State of West Virginia will act on the above application.
Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Such comments or requests should be addressed to:

The public comment period begins February 13, 2023 and ends March 15, 2023.

Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information.
The application, draft permit and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. on business days.
