By virtue of that certain Deed of Trust made by Matthew W. Gray and Holly R. Gray, to John E. Gompers, Trustee, dated the 15th day of May, 2015, and of record in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book No. 961, at page 79, and that certain Appointment of Successor Trustee, dated the 14th day of November, 2022, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1108, at page 80, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 28th day of February, 2023, at 10:30 o’clock A.M., at the rear door (6th Street entrance) of the Court House of Marshall County, Moundsville, West Virginia, the following described property (“Property”) situate in Clay District, Marshall County, West Virginia, and being more particularly described as follows:
The following described property, together with all the improvements, appurtenances and hereditaments thereto appertaining:
Situated in Clay District, Marshall County, West Virginia:
Beginning at a point on the North side of the County Road 200 feet west of the W.B. Minor and Walter Conner line fence; thence in an eastwardly direction along the north side of said county road a distance of 200 feet to said line fence; thence in a northerly direction along said line fence a distance of 435.6 feet; thence in a westwardly direction following a line parallel with said county road a distance 200 feet; thence in a southerly direction to the place of beginning, containing 2 acres, more or less.
Being the same property conveyed to Matthew Gray and Holly Porter Gray from Terri L. Crow by Deed dated March 29, 2002, and recorded in the office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 626, at page 20.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable; including especially but not limited to the Lien of Main Street Bank secured by Deed of Trust dated May 15, 2015, and recorded in the Marshall County Clerk’s Office in Deed of Trust Book 961, at page 79; and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
