NOTICE OF SALE
UNDER DEED OF TRUST

Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Substitute Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

March 15, 2023
11:00 a.m.

offer for sale certain property described in that certain deed of trust executed by DC HOLDINGS & PROPERTY MANAGEMENT, LLC, to Jennifer L. Morgan and Robert C. Chenoweth, as Trustees, which deed of trust is dated the 17th day of March, 2021, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 600, at Page 338; and given to secure KENNETH SHIFLETT, the payment of a note therein described.

The premises subject to the above-described deed of trust which will be sold at the above stated public auction are all of those certain tracts or parcels of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Elkins, in Elkins Corporation District, Randolph County, West Virginia, and more particularly bounded and described as follows:

FIRST: Part of Lots 158 & 159 of Block 24 of the Graham and Davis Addition to the said City of Elkins, as shown on a plat of said addition of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book Q, at Page 349, the portion of said lots being more particularly bounded and described as follows:

BEGINNING at the corner of said Lot No. 158 at the intersection of the southerly right of way line of Davis Street with the westerly right of way line of Randolph Avenue, and running thence with said westerly line of Randolph Avenue in a southwesterly direction a distance of 119.9 feet to a stake; thence running in a northwesterly direction in a line approximately parallel to the southerly line of Davis Street a distance of 117.75 feet to a stake, corner of a lot formerly owned by D.A. Earle; thence running with the eastern line of said Earle lot in a northeasterly direction a distance of 110 feet to a stake in the southerly right of way line of Davis Street; thence running in a southwesterly direction with the aforesaid line of Davis Street a distance of 70 feet to the point of beginning.

SECOND: Those two parcels of real estate fronting on Randolph Avenue, City of Elkins, Randolph County, West Virginia, to wit:

Parcel One: Lot No. 160 in Block 24 of the Graham and Davis Addition to the said City of Elkins as shown upon the plat of said Addition recorded in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book No. 70, at Page 343.

Parcel Two: That portion of a certain lot lying in the Graham and Davis Addition to the said City of Elkins, known as Lot No. 161 in Block No. 24, as will appear from the plat of said Addition recorded in the said Clerk’s Office in Deed Book 70, at Page 343, which fronts on Randolph Avenue for 55 feet and extends back to an alley.

There is EXCEPTED and RESERVED from Second Parcel, all of that property lying to the southwest of that division line beginning at a found 1″ iron pipe 2.20′ from the edge of Randolph Avenue; N 70-02 W, 44.60′ to a point; N 74-03 W, 53.59 feet to a point; N 74-03 W, 37.07′ to a 1/2 x 18″ iron pipe on said line 7.48 feet from the center of alley, said line depicted on that Plat of Survey for Forrest G. Poe, as surveyed by Stephen D. Teter, LLS #644 in April 1985.

And being the same real estate conveyed to DC HOLDINGS & PROPERTY MANAGEMENT, LLC, by Randolph County Rental Properties, LLC, by virtue of a deed dated March 17, 2021, and of record in the Office of the Clerk of the County Commission Randolph County, West Virginia, in Deed Book 616, at Page 155.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above-described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10% down), or approved line of credit with closing to occur within thirty (30) days. Purchaser accepts subject real estate “AS IS”.

The undersigned Substitute Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
