NOTICE OF TRUSTEE’S SALE
NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated May 4, 2015, and of record in the Office of the Clerk of the County Commission of Summers County, West Virginia, in Trust Deed Book 277, at page 611, executed by Carrie J. Moricle and Charles H. Moricle to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 61h day of April, 2023, at the front door of the Summers County Courthouse, in the City of Hinton, West Virginia. at 9:00 a.m., sell the property hereinafter described, which property was conveyed in said Deed of Trust, and being more particularly described as follows:
BEGINNING at a point found, a steel rebar, being the northeasterly comer of the Follingstad Company on the westerly edge of a 35 foot wide “Open” right of way; thence leave said right of way and with said Company N. 76 05 ‘ W., 62.05 feet to a point found, a steel rebar; thence leave said Company and through the survey N. 76 05′ W. passing through a point set, a steel rebar at 59. 95 feet, in all 81.41 feet more or less to the low water mark of the pond; thence with said low water mark the following several courses and distances; N. 10 49′ E., 51.25 feet; thence N. 03 49′ E., 121.38 feet; thence N. 050 04′ W., 171.94 feet to a point; thence leave said low water mark N. 86 21′ E., passing through a point set, a steel rebar at 11.26 feet, in all 111.26 feet to a point set, a steel rebar on the westerly edge of said right of way; thence with the westerly edge of said right of way S. 04 44′ e., 207.50 feet to a point set, a steel rebar; thence S. 04 44′ E., 160.02 feet to a point set, a steel rebar; thence S. 14 27’ W., 18.61 feet to the place of BEGINNING.
SAID TRACT of land contains 1.00 acre of land more or less as surveyed by Jeffery J. Chambers, L.L.S., in June of 1995, as shown on a map which is of record in the Office of the Clerk of the County Commission of Summers County, West Virginia in Deed Book 184 at Page 2S5.
THERE IS ALSO INCLUDED the benefit of that certain Sewer Easement between S & S Holdings, LLC and William Glenn Roles and Mark Allen Roles, which said easement is of record in the Office of the Clerk of the County Commission of Summers County, West Virginia in Book 249 at Page 286.
And being the same property conveyed to Carrie J. Moricle, by Deed dated the 12th day of June: 2014 from William Glenn Roles and Mark Allen Roles, which said Deed is of record in the Office of the Clerk of the County Commission of Summers County, West Virginia in Deed Book 249 at page 292.
Said property will be sold upon the following terms and conditions:
1. Cash in hand on day of sale.
2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property.
6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property.
7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
