INFORMATION
Notice to Bidders: Qualified bidders may submit bids for project as described in this Document. Submit bids according to the Instructions to Bidders.
Regulatory Requirements:
The bidder’s attention is called to the fact that this contract is subject to the equal opportunity requirements of Executive Order 11246, Section 3 of the Housing and Urban Development Act of 1968.
The contract is also subject to the requirements of the West Virginia Contractor Licensing Act, Chapter 21, Article 11 of the Code of West Virginia. Contractor must be licensed in accordance with the Act at the time of the bid.
The contract is also subject to the requirements of the West Virginia Jobs Act as amended October 17, 2017.
The Contractor must use his best efforts to carry out the City of Wheeling’s Minority Business Enterprise Policy. Specifically, the Contractor must utilize to the greatest extent feasible, minority business concerns that are located in Ohio County, adjacent counties, or within the general trade area.
These requirements shall govern submittal, opening, and award of bids.
The Owner reserves the right to waive any informalities or to reject any or all bids.
Project Identification: Project No. 20-108C – City of Wheeling – Stations 2 & 10 Structural Renovations for the Wheeling Fire Department.

b. Station 10: 298 Poplar Avenue, Wheeling, WV 26003
Owner: City of Wheeling, 1500 Chapline Street, Wheeling, West Virginia.
Owner’s Representative: Mr. Robert Herron, City Manager.
Architect: M&G Architects & Engineers.
Project Description: Work under this contract addresses structural repairs at existing Fire Stations No. 2 (North Wheeling) and No. 10 (Edgwood) in Wheeling. Work includes selective demolition/shoring as required, protection/relocation of existing utilities, installation of structural steel components, concrete/masonry work, and removal and replacement of miscellaneous architectural finishes to access work areas.
Construction Contract: Bids will be received for the following Work:
General Contract (all trades).
BID SUBMITTAL AND OPENING
Owner will receive sealed lump sum bids until the bid time and date at the location given below. Owner will consider bids prepared in compliance with the Instructions to Bidders issued by Owner, and delivered as follows:
Bid Date: March 31, 2023.
Bid Time: 2:00 p.m., local time.
Location: City Manager Conference Room, City County Building, 1500 Chapline St., Wheeling, WV 26003
Bids will be thereafter publicly opened and read aloud.
BID SECURITY
A. Bid security shall be submitted with each bid in the amount of 5 percent of the bid amount. No bids may be withdrawn for a period of 30 days after opening of bids. Owner reserves the right to reject any and all bids and to waive informalities and irregularities.
MANDATORY PREBID MEETING
Mandatory Prebid Meeting: A Mandatory Prebid meeting for all bidders will be held in the City Manager’s conference room, 1500 Chapline St., Wheeling, WV 26003 on March 17, 2023 at 2:00 p.m., local time. Prospective prime bidders are required to attend.
Bidders’ Questions: Architect will provide responses at Prebid conference to bidders’ questions received up to three business days prior to conference.

TIME OF COMPLETION AND LIQUIDATED
DAMAGES
The successful bidder shall begin the Work on receipt of a Notice to Proceed and shall achieve Substantial Completion of the Work within a Contract Time of 126 calendar days.
The Owner will suffer financial loss if the work is not substantially complete within this time period and therefore if this time period is exceeded, the Contractor and the Contractor’s Surety shall be liable for and shall pay the Owner liquidated damages, not as a penalty, in the sum of $500.00 per day until Substantial Completion is achieved.
Allowances may be made for delays due to shortages of materials or other resources, subject to proof by documentation and also for delays beyond the control of the Contractor.
BIDDER’S
QUALIFICATIONS
Bidders must be properly licensed under the laws governing their respective trades and be able to obtain insurance and bonds required for the Work. A Performance Bond, separate Labor and Material Payment Bond, and Insurance in a form acceptable to Owner will be required of the successful Bidder.
