TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated April 8, 2016, and duly recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Document No. 230779, in Book No. 760, at Page 336, and modified in Trust Deed Modification in Document No. 304331, in Book 877, at Page 368, Jonathan C Lord, a single man, and Chentell L Withrow, a single woman, did convey unto David M. Moore, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by U.S. Bank National Association not in its individual capacity but solely as Legal Title Trustee for RMTP Trust, Series 2021 BKM-TT-V to foreclose thereunder, will offer for sale at public auction at the front door of the Greenbrier County Courthouse in Lewisburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 04 – Falling Springs District, Greenbrier County, West Virginia, and more particularly described as follows:
Beginning at a 3/4” iron pipe set at the intersection of Sec Rt. 5 and a private road, referenced N54-25W 75.3 to a 1/2” iron pipe set at down fence post, corner of parent tract of 103 acres and 30 poles described in DB 120 P. 78, also a corner of a parcel owned by Kathleen Snell DB 323 P. 658, Leave Rt. 5 and up east bank of private road, N55-11E 226.4’ 1/2” iron pipe set east of road and north of small drain witnessed S 35-45E 3’ to a 6” locust, leave private road S51-15E 153.5’ 1/2” iron pipe set, witnessed S 80-30W 1.5’ to 12” Black Walnut S820W 96.3’ 1/2” iron pipe set at 5” hickory S15-30E 282.1’ 1/2” iron pipe set west of drain S51-00W 106.3’ 1/2” iron pipe set on north edge of Rt. 5 R/W, witnessed N 59-45E 3’ to 3” white oak; S89-30E 2.6’ to 4” white oak; S76-20E 3.5’ to 3” white oak, with north side of Rt. 5 R/W N39-30W 416.9’ 1/2” iron pipe set N 14-15W 81.0’ to the beginning and containing 2.33 acres as surveyed May 15, 1986 by Earl Roth, Renick, W.Va.” RIGHT OF WAY Beginning at a stake set S 51-15 E 100.00 feet from an iron pin set in the corner of the 2.33 acre tract N 55-11 E 226.4 feet from Secondary Rt. 5 and in the line of a private road; thence leaving said private road in an arc 100 feet from the aforementioned corner to the west side of said private road, together with the right to use said private road to the said Secondary Rt. 5 and over Rt. 5 to U.S. 219.
And being the same tract or parcel of land which was conveyed unto Judy McMillion Christian and Jewell C. Dolan by Jewell C. Dolan, widow, by deed dated February 17, 2000, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Deed Book 561, at page 47. The said Jewell C. Dolan conveyed all her right, title and interest in and to subject property to the said Judy McMillion Christian by deed dated May 14, 2004, of record in the aforesaid clerk’s office in Deed Book 573, at page 392. Reference is hereby made to all prior instruments in the chain of title for all reservations, restrictions, and limitations pertaining to the real estate herein conveyed.
It is the intention of this conveyance to vest title to said property in the parties of the second pan, Chentell L Withrow and Jonathan C. Lord, or the survivor, jointly and equally, and to the survivor of either of them, so that upon the death of either, the entire interest in said property will immediately vest in the survivor.
And being the same property conveyed unto Chentell L. Withrow and Jonathan C. Lord by deed dated April 8, 2016 from Judy McMillion Christian and not yet of record, but to be recorded prior to or simultaneously herewith.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 4718 Leonard Cordova Road, Renick, WV 24966.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
