TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 26, 2009, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Document No. 50361043, in Book No. 5036, at Page 1043 and modified in Document No. 50659318 (MOD), in Book No. 5065, at Page 9318, Steven E Murdock and Sarah Murdock did convey unto Richard A. Pill, Esq., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 09 – Slab Fork District, Raleigh County, West Virginia, and more particularly described as follows:

The following situate in Slab Fork District, County of Raleigh, and the State of West Virginia and being more particularly described as follows:
FIRST TRACT: BEGINNING at a stake in the east line of a 30-foot road that runs from the County road (now State Highway leading from Coal City to Pemberton) to the former Hungate tract, which stake bears S. 79deg. 48′ E. 31.7 feet from a sourwood stump, a corner of the former P.E. Lilly 308-acre tract; thence S. 79deg. 48′ E and along what was known as the former Hungate line, a distance of 593 feet to a corner of what was known as C.T. Mooney and E.C. Hungate; thence with Mooney N. 4deg. 6′ E. 217.6 feet to another corner of Mooney; thence S. 79deg. 48′ W. 123.3 feet to a stake, a corner formerly to Mooney (now Elliott); thence N. 7deg. 50′ W. 75 feet to a stake; thence through what is known as the 5.77 acre tract owned by Elie H. Meadow and Joyce Meadows, his wife, approximately S. 79deg. 48′ W. 475 feet to a stake on the east line of said 30-foot road; thence along said road line S. 8deg. 50′ E. 100.5 feet to the point and place of beginning, containing approximately 2.3 acres, more or less.
These is EXCEPTED and RESERVED from this tract a certain parcel of land conveyed unto Willie Reeves by deed dated June 29, 1963 from Elzie H. Meadows of record in the aforesaid Clerk’s Office in Deed Book 422, at page 421.
Subject to any part or portion of the property herein described that may be utilized by the public as a part of the said thirty (30) foot road herein referred to.
SECOND TRACT: BEGINNING at a sourwood stump, a corner to J.C. Connor; thence S. 79deg. 48′ E. 624.9 feet to a stake; thence N. 77deg. 24′ E 277.8 feet to a stake, thence S. 14deg. 04′ W 250.6 feet to a stake, thence N. 70deg. 50′ W. 136.7 feet to a stake; thence S. 49deg. 50′ W. 375.1 feet to a stake; thence N. 60deg. 59′ W. 417.7 feet to a stake on J.C. Connor’s lien and with his line N. 8deg. 43′ W. 290.9 feet to the beginning, containing 5.58 acres, more or less.
There is EXCEPTED and RESERVED from this tract a certain parcel containing 1.80 acres conveyed unto David B. Jones by deed dated June 24, 1943, from C. H. Mack of record in the aforesaid Clerk’s office in Deed Book 211, at page 500.
There is further EXCEPTED and RESERVED from this tract a certain parcel containing 0.7624 conveyed to Winford C. Hylton by deed dated June 14, 2004 from Patricia E. Wood of record in the aforesaid Clerk’s office in Deed Book 5013, at page 8777.
There is also EXCEPTED and RESERVED a 30′ access and utility easement containing 0.1009 acre conveyed in the aforementioned deed.
And being the same property acquired by Steve Murdock and Sara Murdock, by deed dated June 10, 2009, from Beneficial West Virginia, Inc., to be recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, prior to or simultaneously herewith.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 175 Hungate Road, Coal City, WV 25823.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $6000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
