NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 3, 2021, executed by Borrower, Christopher L Brown, to Angela C Ramsey, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5075, at Page 1397. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 112 Pershing St, Beckley, WV 25801. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 3, 2023, of record in the Clerk’s Office in Book 5079, Page 6733. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

The following described tracts or parcels of land, located in Burgess Addition to the City of Beckley, Raleigh County, West Virginia, and being Lot Nos. 12 and 13 of said Burgess Addition, as shown and designated upon a map of said Burgess Addition filed in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book No. 3, at Page 38, which said lots are more particularly bounded and described as follows: TRACT ONE BEGINNING at a stake in the south line of Pershing Street the common corner between Lot No. 12 of the aforesaid Burgess Addition and the aforesaid Lot No. 13; thence S 51deg. 19` E, with the south line of Pershing Street 50 feet to a stake at the intersection of the aforesaid Pershing Street and Randolph Street; thence with the west line of Randolph Street, S 38deg. 41` W 161.83 feet to a slake leaving the end of Randolph Street at 141.83 feet; thence N 30deg. 31` W 4 7 .25 feet to the stake in the eastern line of Burgess Street; thence with the eastern line of Burgess Street N 55deg. 59` 33.6 feet to the stake at the corner of Burgess Street; thence with the northern line of Burgess Street, N 30deg. 16` W 4.0 feet to a stake, the common corner of this lot and the aforesaid Lot No. 12; thence N 38deg. 41` E and with the common line between this lot and the aforesaid Lot No. 12, 123.68 feet to the point of beginning TRACT TWO BEGINNING at a stake in the western line of Pershing Street, a common corner between Lot No. 13 of the Burgess Addition and the lot herein conveyed; thence with the common line between the aforesaid Lot No. 13 and lot herein conveyed, 123.66 feet to a stake in the eastern line of Burgess Street, a common corner between the aforesaid Lot No. 13 and the lot herein conveyed; thence with the aforesaid line of Burgess Street in the northern direction 50.18 feet to a stake in said line of Burgess Street, being the common corner between the lot herein conveyed and Lot No. 11 of the aforesaid Burgess Addition; thence with the common line between the lot herein conveyed and the aforesaid Lot No. 11, 119.29 feet to the stake in the aforesaid western line of Pershing Street, a common corner of the lot herein conveyed and the aforesaid Lot No. 11; thence with the aforesaid line of Pershing Street in a southern direction 50 feet to the point of beginning. EXCEPTING and RESERVING from the above conveyances, those certain out-conveyances as follows: (1) deed dated October 31, 1941, of record in the aforesaid Clerk`s Office in Deed Book 178, at Page 372, from Fred Cantabery and Bertha M. Cantabery, his wife, to S. E. Hodson and Monnie E. Hodson, his wife, and (2) deed dated January 28, 1953, of record in the aforesaid Clerk`s Office in Deed Book 309, at Page 475, from Bertha May Cantabery and Fred Cantabery, her husband, to Dorothy Hazel Patton. This Deed is made and accepted subject to all reservations, exceptions, stipulations, conditions, and easements heretofore made or granted by all predecessors in title to the real estate herein conveyed, except any pertaining to race, color or creed.

Being the same property conveyed to Christopher L Brown by the Deed dated November 3, 2021 and recorded in Deed Book 5075 at Page 1396 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
