By virtue of that certain Deed of Trust made by Shani J. Haller and Shirley A. McCormick to John E. Gompers, Trustee, dated the 4th day of November, 2011, and of record in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book No. 1424, at page 774 (the said Shirley A. McCormick died September 4, 2019 vesting full title to subject property to Shani J. Haller by joint tenancy with right of survivorship), and that certain Appointment of Successor Trustee, dated the 2nd day of May, 2023, and of record in the aforesaid County Clerk’s office in Deed of Trust Book No. 1672, at page 609, the undersigned will sell at public auction, and subject to the terms and conditions set forth in this Trustee’s Notice of Sale and in the said Deed of Trust, on the 15th day of June, 2023, at 10:00 o’clock A.M., at the northwest front door of the Court House of Ohio County, Wheeling, West Virginia, the following described property (“Property”) situate at 11 Greenwood Avenue, Wheeling, Ohio County, West Virginia 26003, and being more particularly described as follows:
Situate in the City of Wheeling, in Triadelphia District, Ohio County, West Virginia, that is to say:
All of Lot Numbered Twenty-Five (25) as shown and defined on the Plat of Dimmeydale Addition No. 2, which plat is of record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book 2, at page 91, reference being made thereto for a more particular description of the lot hereby conveyed.
The part of the second part hereby covenants and agrees not to erect or cause to be erected any building or other structure, excepting an open porch, piazza or stoop, within twenty (20) feet of the front line of the said lot; nor to erect or cause to be erected upon said lot any principal building or structure, the cost of which will be less than Twenty-Five Hundred Dollars ($2,500.00), nor to erect or cause to be erected any fence or fences of any kind whatsoever on the front part of said lot.
All the coal, oil, gas and other minerals underlying said lot are excepted and reserved and not hereby conveyed.
TERMS OF SALE: Sale of the Property will be made subject to the lien for any and all real estate taxes, whether or not currently due, owing, delinquent or payable, whether paid or are otherwise not currently payable, and further, sale of the subject interest in the Property is subject to any and all other liens, encumbrances, or adverse claims of interest which may be superior to the lien of the Deed of Trust being foreclosed upon or the title of Successor Trustee hereunder. The Property will be conveyed “As Is”, without warranty or representation, express or implied, as to title, physical condition, environmental condition or any other adverse condition which might affect merchantability, marketability, fitness or use of the Property. CASH IN HAND or CERTIFIED FUNDS (Certified Check) in full in the amount of the successful bid or bids on the day of the sale is required for any bidder to purchase the subject Property.
