NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 15, 2021, executed by Borrower(s), Bruce L Carter, to Metz Law Offices, PLLC, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4545, at Page 878. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 32 Lilac Dr, Elkview, WV 25071. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated April 17, 2023, of record in the Clerk’s Office in Book 4638, Page 493. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 19th day of July, 2023 at 11:30 a.m. All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate about 0.50 miles South of Blue Creek on Imhoff Branch of Elk River, Elk District, Kanawha County, West Virginia as described on that certain Plat made by C. T. Tolley, Jr., LLS No. 92, dated the 25th day of July, 1977, which said Plat is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1842, at Page 119 and being further bounded and described as follows: Beginning at an iron rod in the division line of wire fence by a four (4) inch dogwood between Inez S. Morris, Carl and Maxine Givens said iron rod being located N. 85DEGREES 10` W., 68.08 feet to an iron rod by a large twin poplar, an original corner to the entire tract of which this is a part; thence S. 37DEGREES 05` E., 283.12 feet to an iron rod in the northwest right-of-way line of a twenty (20) foot road right-of-way; thence with said right-of-way line S. 54DEGREES 28` W., 144.20 feet to an iron rod at the intersection of said twenty (20) foot right-of-way and a thirty-five (35) foot road right-of-way; thence leaving said twenty (20) foot road right-of-way and with the northeast right-of-way line of said thirty-five (35) foot road right-of-way N. 51DEGREES 40` W., 111.00 feet to an iron rod; thence leaving said right-of-way line and through the tract of which this is a part N. 37DEGREES 46` E., 100.91 feet to an iron rod; thence N. 20DEGREES 17` W., 174.63 feet to an iron rod by a twenty-four (24) inch cedar tree in a wire fence in Carl and Maxine Givens` line; thence with said line S. 85DEGREES 10` E., 32.66 feet to the beginning, containing 0.66 acres, more or less. Being the same property conveyed to Bruce L Carter by the Deed dated September 30, 2021 and recorded in Deed Book 3112 at Page 637 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
