TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 29, 2019, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 19702919, in Book No. 1588, at Page 398 and modified in Document No. 19740451 (MOD), in Book No. 1642, at Page 244, Christopher L Simmons did convey unto Showcase Title Agency, Inc. (WV), Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 04 – Richland Country District, Ohio County, West Virginia, and more particularly described as follows:
A parcel of ground situate on Peter’s Run, Richland District, Ohio County, West Virginia; being Parcel Number Eight (8) as shown on the Map of Homestead Farms, recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book No. 2, at page 79, and bounded and described as follows: Beginning at a point in the center of the traveled part of the Peter’s Run County Road; which point is located N. 18 degrees 09′ W. 161.55 feet and N. 11 degrees 24′ W. 108.45 feet from the Southeasterly corner of the cement bridge crossing Peter’s Run leading to Stewart’s Hill Country Road; thence N. 18 degrees 25′ W. 200 feet to a point in the traveled part of Peter’s Run Country Road; thence S. 71 degrees 35′ W. 389.17 feet to a stake; thence S. 12 degrees 13′ E. 201.18 feet to a stone which also marks the Northwesterly corner of Parcel Seven (7) of Homestead Farms; thence N. 71 degrees 35′ E. 410.90 feet to the place of beginning, and containing one and eighty-four hundredths (1 and 84/100) acres, more or less.
Excepting and reserving, however, the following described parcel of ground: Beginning at a point in the center of the traveled part of the Peter’s Run Country Road; which point is located N. 18 degrees 09′ W. 161.55 feet, and N. 11 degrees 24′ W. 108.45 feet from the Southeasterly corner of the cement bridge crossing Peter’s Run leading to Stewart’s Hill Country Road; thence N. 18 degrees 25′ W. 75 feet to a point in the traveled part of Peter’s Run Country Road; thence S. 71 degrees 35′ W. 402.75 feet to a stake; thence S. 12 degrees 13′ E. 75.44 feet to a stone which also marks the Northwesterly corner of Parcel Seven (7) of Homestead Farms; thence N. 71 degrees 35′ E. 410.90 feet to the place of beginning, containing seventy-one hundredths (0.71/100) of an acre.
All coal, coal mining rights and privileges having heretofore been conveyed are excepted and reserved from this conveyance.
This conveyance is made subject, however, to all of the restrictions, covenants, exceptions, conditions, limitations and reservations contained in all prior deeds of conveyance.
The Grantors have no actual knowledge or reason to believe that the property, including its substrata or subsurface, has been used for the storage, treatment or disposal of hazardous waste or that it contains or did contain any underground storage tanks.
Being the same property which was heretofore conveyed to Lisa M. Nolte by Matthew Walker and Jennifer Walker, husband and wife, by a Deed dated the 29th of May, 2008, and recorded in the aforesaid County Clerk’s office in Deed Book No. 785, at page 409.

At the time of the execution of the Deed of Trust, this property was reported to have an address of:
772 Peters Run Rd, Wheeling, WV 26003.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $8000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
