PUBLIC SERVICE COMMISSION OF WEST VIRGINIA CHARLESTON CASE NO. 23-0010-S-DU HUBBARD HEIGHTS SUBDIVISION HOMEOWNERS ASSOCIATION, Petition for determination that Hubbard Heights Subdivision Homeowners Association is a distressed or failing utility under W.Va. Code 24-2H-1 et seq. REVISED NOTICE OF HEARING On January 5, 2023, a resident of the subdivision filed a letter requesting that this Commission review Hubbard Heights Subdivision Homeowners Association (Hubbard) under the Distressed and Failing Utilities Improvement Act, W.Va. Code 24-2H-1 et seq. He represented that Hubbard has no current board members or operations. The Commission opened this matter and referred the proceeding to its Division of Administrative Law Judges for hearing and public comment. Commission Staff subsequently recommended the Commission find Hubbard is a failing wastewater utility and order its transfer to a capable proximate utility. The Town of Ceredo, Northern Wayne County Public Service District, Kenova Municipal Sewer, Spring Valley Public Service District and the Sanitary Board of the City of Huntington have been designated as potential capable proximate utilities that could assume the operation or ownership of Hubbard if necessary. This matter has been scheduled for public comment and an evidentiary hearing on July 25, 2023, at 11:00 a.m., at the Kenova Department of Public Safety, Conference Room, 2nd Floor, 1501 Pine Street, Kenova, West Virginia. The June 22, 2023 Hearing was cancelled. The public hearing shall be conducted to receive comment from interested individuals, including comment regarding options available to bring the distressed or failing utility into compliance with statutory and regulatory standards. At the evidentiary hearing, the Commission shall receive evidence to determine (i) if the utility is a failing utility, (ii) whether a capable proximate utility should acquire or manage Hubbard or (iii) if there is a reasonable alternative disposition.
