NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 3, 2003, executed by Borrower(s), Frances Ramona Lawton, to Home Connects Lending Services, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3055, at Page 141. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 170 Riverhaven Road, Clendenin, WV 25045. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 18, 2023, of record in the Clerk’s Office in Book 4645, Page 770. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 7th day of August, 2023 at 12:30 p.m. All that parcel of land in City of Clendenin, Kanawha County, State of West Virginia, as more fully described in Deed Book 2371, Page 26, ID#2271, being known and designated as metes and bounds property. By fee simple Deed from William Conley and Rosemary M. O`Connor Conley, husband and wife as set forth in Book 2371 Page 26 dated 91/81/8995 and recorded 91/81/8995, Kanawha County Records, State of West Virginia. And being more particularly bounded and described as follows: Beginning at a No. 5 rebar set in the northerly right of way line of B&O Railroad line, being 33 feet from the center point thereof; thence from said beginning point, N. 9 degrees 29` W. 136.62 feet to a ONE-HALF inch galvanized pipe set; thence continuing N. 9 degrees 29` W. 39.32 feet to the Elk River; thence down said River N. 82 degrees 53` W. 39.32 feet to a point; thence continuing S. 89 degrees 51` W. 143.87 feet to a point; thence leaving Elk River and towards the right of way line of the B&O Railroad S. 25 degrees 49` E. 32.17 feet to a ONE-HALF inch galvanized pipe set; thence continuing S. 25 degrees 49` E. 209.00 feet to a 31/2 inch galvanized pipe set in the northerly right of way line of the B&O Railroad and 33 feet from the centerline thereof; thence with said right of way line N. 64 11` E. 28.02 feet; thence continuing with said right of way line on a chord bearing N. 67 degrees 38` E. 96.37 feet to the place of beginning, and containing in all 0.5845 acres, all as set forth and depicted upon that certain map entitled “Plat Showing Survey and Division of a Parcel of Land on the Waters of Elk River Being the Residue of the R.E. Eskins 307 Acre Tract, Big Sandy District, Kanawha County, West Virginia, Surveyed for Judy E. Conley, “dated November 5, 1990, and made by William R. Gunnoe, R.R.S., a copy of which is attached to Deed dated November 13, 1990, from Judy E. Conley and Bernard Carl Conley, her husband, to William Conley and Rosemary M. O`Connor Conley, his wife, which deed is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2259 at page 874. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
