IN THE CIRCUIT COURT OF WOOD COUNTY, WEST VIRGINIA Civil Action No. 23-C-150 Judge John D. Beane GRAND CENTRAL PARKERSBURG LLC, a Delaware limited liability company, Plaintiff, v. SPUD TECHNOLOGIES LIMITED, a West Virginia limited liability company, THE LOADED POTATO LLC, a West Virginia limited liability company, DAVID ADKINS, individually; and DAVID ALAN ADKINS II, individually, Defendants. ORDER OF PUBLICATION TO: SPUD TECHNOLOGIES LIMITED THE LOADED POTATO LLC DAVID ADKINS DAVID ADKINS II The object of the above-entitled action is to recover past due rent and other occupancy charges due and owing pursuant to a lease between the parties, for which Defendants have defaulted, as is more particularly described in the Complaint filed herein. It appearing by Affidavit filed in this action that Defendant SPUD TECHNOLOGIES LIMITED, is a West Virginia limited liability company; Defendant THE LOADED POTATO LLC is a West Virginia limited liability company; Defendant DAVID ADKINS is a resident of Cabell County, West Virginia; and Defendant DAVID ADKINS II is a resident of Cabell County, West Virginia; that the Plaintiff unsuccessfully attempted to obtain service of the Summons and Complaint upon the Defendants Spud Technologies Limited and The Loaded Potato LLC via the West Virginia Secretary of State and Defendants David Adkins and David Adkins II via certified mail, and that the Plaintiff has used due diligence, pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure, to ascertain the address or whereabouts of Defendants but has not been successful in so doing. It is therefore ORDERED that SPUD TECHNOLOGIES LIMITED, THE LOADED POTATO LLC, DAVID ADKINS and DAVID ADKINS II appear and serve upon Kayla A. Cook, Bowles Rice LLP, counsel for Plaintiff, whose address is 125 Granville Square, Suite 400, Morgantown, West Virginia, 26501, a response or other defense to the Complaint heretofore filed in this action within 30 days after the date of first publication of this notice. Otherwise, the Court may render a judgment of default against SPUD TECHNOLOGIES LIMITED, THE LOADED POTATO LLC, DAVID ADKINS and DAVID ADKINS II at any time thereafter, thereby granting the relief requested by Plaintiff in the Complaint. A copy of said Complaint can be obtained from the Office of the Clerk of the Wood County Circuit Court, Wood County Judicial Building, 2 Government Square, Room 131, Parkersburg, WV 26101-5353.
