TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated March 8, 2019, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book No. 4352, at Page 775, Alicia F Herald and Michael J Herald did convey unto Robert H Skeen, Jr., Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MidFirst Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse in Charleston, West Virginia, on August 29, 2023 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 23 – Malden District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot, tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate at Burning Springs, Malden District, Kanawha County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at an iron pipe at the northwest corner of the lot and at the northeast corner of the lot transferred September 25, 1934, by Leona B. Groah and L. J. Groah to Jennings W. Groah and Marie Helena Groah and running easterly by the line of the road sixty-three (63) feet to an iron pipe at the northwest corner of other land belonging to Leona B. Groah; thence in a southerly direction by said Leona B. Groah’s lands two hundred seventy (270) feet to an iron pope and lands of Newman Groves; thence westerly by said Grove’s lands sixty-three (63) feet to an iron pipe at the southeast corner of the lot transferred September 25, 1934, by Leona B. Groah to Hennings W. Groah, et al, as mentioned above; thence northerly by said Jennings W. Groah’s land two hundred seventy (270) feet to the point of beginning. There is EXCEPTED and RESERVED from this conveyance the following 63′ x 100′ tract or parcel of land: BEGINNING at a point being the southwest corner of a 63′ x 270′ lot as described in Deed Book 1718, at page 297, said point also being in the north line of the Farah Dupont City Addition; thence northerly with the east line of said lot a distance of one hundred (100) feet; thence westerly through and across said lot sixty-three (63) feet, more or less, to a point in the westerly line of said lot; thence south with said line to a point in the north line of said addition; thence easterly sixty-three (63) feet, more or less, to the point of beginning, containing six thousand three hundred (6,300) square feet, more or less, and being the southern one hundred (100) feet of said 63′ x 270′ lot. LSOT: Deed Book 2761, Page 983, dated January 14, 2010, Office of the Clerk of the County Commission, Kanawha County, West Virginia. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 90 W 34th St, Belle, WV 25015. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and r certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
