TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated March 3, 2010, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 3709, at Page 608, Walter Clayton Finley, Jr. and Rebecca E. Finley and Gloria Francis Finley did convey unto Barry Dobson and Clayton Rice, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on September 6, 2023, at 5:56 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Nitro District, Kanawha County, West Virginia, and more particularly described as follows: Situated in the City of Nitro, Union District, Kanawha County, West Virginia, and being all of Lot No. Forty (40), Section Five (5), as the same is shown and designated upon a revised map of a part of Sattes, which map is of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 16, at Page 101; At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1301 Valentine Circle, Nitro, WV 25143-2355. AND BEING the same real estate which was conveyed to Walter C. Finley and Lula S. Finley by Deed dated April 12, 1958 and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 1241, at Page 473. The said Walter C. Finley passed away and title vested in Lula S. Finley. The said Lula S. Finley passed away from this life on January 24, 1989 and pursuant to her Last Will & Testament, of record in the aforesaid Clerk’s Office in Book 481, at Page 353, the real estate was devided to Walter Clayton Finley, Jr. and Gloria Francis Finley. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
