TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated February 10, 2003, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 2941, at Page 384, John F. Good and Thelma R. Good did convey unto Lew G. Tyree and Samme Gee, Trustee, certain real property described in said Deed of Trust; said Deed of Trust was modified by loan modification of record in Deed of Trust Book 4220, at Page 43, and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on September 6, 2023, at 5:50 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Malden District, Kanawha County, West Virginia, and more particularly described as follows: All those two certain lots or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on Georges Creek in Malden District, Kanawha County, West Virginia, and being part of Lots Nos. 29 and 30 of the Young Subdivision, as shown upon a map of the same entitled “Mortgage Verification for John F. and Thelma R. Good showing Part of Lots 29 and 30 Young Subdivision located at 805 Georges Drive, Charleston, WV, Malden District, Kanawha County, West Virginia, Scale: 1” = 30 Feet Date: December 23, 2002. Said Lot No. 29 is described as follows: BEGINNING at an iron pin on the east line of Georges Creek Road, common corner between Lots Nos. 28 and 29; thence with one line of Lot No. 28 N. 64DEGREES 15′ E. 93.45 feet to an iron pipe; thence S. 56DEGREES 43′ E. 58.50 feet to an iron pin, corner to Lot No. 30; thence with the one line of same S. 64DEGREES 15′ W. 116.20 feet to an iron pipe on the east line of Georges Creek Road; thence down said road N. 25DEGREES 45′ W. 33.75 feet to a stake; thence N. 43DEGREES 30′ W. 17.26 feet to the place of beginning, containing 0.12 acre, more or less. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 805 Georges Drive, Charleston, WV 25306. AND BEING the same real estate which was conveyed to John F. Good and Thelma R. Good, by Deed dated February 10, 2003, from Thomas E. Skaggs and Susan L. Skaggs, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2569 at Page 656. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
