NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, and Eric M. Johnson and John M. Harshbarger, by that certain Deed of Trust made by Gail W. Medley and Rosalie G. Medley, dated February 25, 2011 and recorded March 11, 2011 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3783 at page 629, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated July 13, 2023 and recorded July 17, 2023 in the aforesaid Clerk’s office in Trust Deed Book 4651, at page 83, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on Friday, September 22, 2023 at 11:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in South Charleston, Jefferson District, Kanawha County, West Virginia, being more particularly bounded and described as follows: Being a lot located along West Virginia Secondary Route No. 603/8, West Spring Hill, Jefferson District, Kanawha County, West Virginia: Beginning at a 51/3 inch iron rod in the northeast right-of-way line of West Virginia Secondary Route No. 603/8 and the northwest right-of-way line of a ten (10) foot alley; thence with right-of-way line of West Virginia Secondary Route No. 603/8 N 46 degrees 26′ W – 81.54 feet to a point; thence N 49 degrees 04′ W – 68.48 feet to a 51/3 inch iron rod; thence leaving said right-of-way N 25 degrees 22′ E – 78.96 feet to a 51/3 inch iron rod in a drain and in the south right-of-way line of Chesapeake and Ohio Railroad right-of-way; thence with said right-of-way line S 70 degrees 35′ E – 201.48 feet to a point in the northwest right-of-way of a ten (10) foot alley; thence leaving Chesapeake and Ohio Railroad right-of-way and with the northwest line of said ten (10) feet alley S 47 degrees 00′ W – passing a 5.8 inch rod on line at 4.79 feet, in all 154.38 feet to the beginning. Containing 0.44 acres, more or less, as surveyed by C.T. Tolley, Jr., Land Surveyor, October 9, 1980. It is understood that this 0.44 acre parcel is subject to any legal interpretations of the rights of the Chesapeake and Ohio Railway Company or its assigns and of the rights of record in the road way known as The “James River and Kanawha Turnpike” and “Kanawha Turnpike” or “W. Va. Secondary Route 603/8”, according to survey by William D. Mason, P.E.C.E., of Charleston, West Virginia. Being part of a 34.78 acre tract of land conveyed to Gail W. Medley dated November 25, 1980, and recorded in the Office of the Clerk of the County Court of Kanawha County, West Virginia, in Deed Book 1965, at Page 83. At the time of execution of the deed of trust, the grantor represented that the address of the property was 5346 Main Drive, South Charleston, WV 25309. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and City National Bank shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
