NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 27, 2017, executed by Borrower(s), Jeffery S. Goodman and Chelsea M. Goodson, to Pill & Pill, PLLC, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4272, at Page 95. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5258 Greywood Dr, Charleston, WV 25313. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 30, 2023, of record in the Clerk’s Office in Book 4651, Page 265. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 18th day of September, 2023 at 11:30 a.m. All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Union District, Kanawha County, West Virginia, being a part of Lot Seventeen (17) of Matthews Baby Farms Addition, as shown and designated on a map thereof made by C. W. Godfrey, Engineer, dated July, 1938, of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 8, at page 13, and also shown upon a map recorded with the deed from Otis Taylor and wife to Dennis Taylor dated April 19, 1957, of record in the aforesaid Clerk`s Office in Deed Book 1210, at page 147, which map was made by Field Engineering Co. and is dated March 29, 1957, the parcel hereby conveyed being more particularly bounded and described as follows: BEGINNING at a concrete monument at the southeast corner of Lot 17 of Matthews Baby Farms, as shown upon the map aforesaid, which concrete monument is in the north edge of Ridge Road, and is the division line between Lots 17 and 18 of the said Matthews Baby Farms; thence with the north line of said Ridge Road N. 89 degrees 26` W 71 feet to a point; thence with the line parallel to the division line between Lots 17 and 18 N. 1 degree 50` E. 125 feet to a point; thence with the line parallel to Ridge Road S. 89 degrees 26` E. 71 feet to a point in the division line between Lots 17 and 18; thence with said division line S.1 degree 50` W. 125 feet to the place of beginning. Along with that certain right of way as described in the deed from Ben Oliver and Sheila Oliver to Michael L. Kidd and Lisa A. Kidd, his wife, being an easement as extended by a deed from Otis Taylor and W. O`Dell and wife by deed dated November 9, 1961, of record in the aforesaid Clerk`s Office, for ingress and egress and for utilities, over a private driveway known as Dublin Road to and from Big Tyler Mountain Road, as shown on the said plat made by Field Engineering Co. of record with the deed in the aforesaid Clerk`s Office in Deed Book 121, at page 147. Along with that certain right of way as more particularly described in the deed from Otis Taylor and Velda Taylor, his wife, to Harry C. Shumate dated December 19, 1963, of record in the aforesaid Clerk`s Office in Deed Book 1399, at page 98, being the same right of way, stating for ingress and egress and utilities, being in width from 14 to 18 feet to and from Big Tyler Mountain Road. Dublin Road is hereby extended 24 feet wide from S. E. Corner of parcel of land conveyed to Oral O`Dell and wife November 9, 1961, to a point in the northwest corner of parcel hereby conveyed. The western line of said 24 feet extension of Dublin Drive shall be an extension of the east line of the O`Dell property and the easterly line of the extension of Dublin Drive, and shall begin at a point 5 feet east of the southwest corner of the Clyde Lemon parcel for a distance of 73.85 feet west of the common division line between Lots 17 and 18 as shown on Field Engineering plat. Said deed further recites that the said Dublin Drive, as extended, does not touch the property hereby conveyed and an easement 15 feet wide running from the northwest corner of the property hereby conveyed in a southerly direction for a distance of 15 feet between the said property hereby conveyed and the said Dublin Drive as extended is hereby granted by the party of the first part to the party of the second part for access to and from said Dublin Drive extension. Dublin Drive is extended only to the property hereby conveyed and the said Dublin Drive shall not be extended to, opened or used as or for ingress and egress to and from Ridge Road through the property hereby conveyed, as access to Big Tyler Mountain Road. Being the same property conveyed to Jeffery S. Goodman and Chelsea M. Goodson by the Deed dated October 27, 2017and recorded in Deed Book 2985 at Page 328 in the Office of the Clerk of the County Commission of Kanawha County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
