NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated January 21, 2013, executed by Borrower(s), John D. Adkins, to Dru A. Shope, Esq., the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2470, at Page 726. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2641 Glenwood Rd, Milton, WV 25541. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 11, 2023, of record in the Clerk’s Office in Book 416, Page 125. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Nibert thence leaving the tract of land owned by Don K. and Shirley L. Smith and running with the land owned by Michael D. Nibert. S. 22DEGREES 08` 21 E. 108.19` to a large spike nail (Set) in a private gravel road, being a common corner to the lands now or formerly owned by Delmar and Marvel Hammicks (Tax Map and Parcel in error) thence leaving the tract of land owned by Michael D. Nibert and running with the land owned by Delmar and Marvel Hammicks. S. 53DEGREES 14` 48″ W. 215.55` to a calculated point in the center of the Right Fork of Lower Creek being a common corner to the lands now or formerly owned by Reba Stowasser (Deed Book 1135, Page 709) thence leaving the tract of land owned by Delmar and Marvel Hammicks and running with the land owned by Reba Stowasser. N. 12DEGREES 38`43″ E. 160.47` to a 51/3″ Rebar and Cap (set) on the north road bank of a private road, being a common corner to Reba Stowasser and being a common corner to the aforesaid Don K. and Shirley L. Smith from which a 1 ONE-HALF” Galvanized iron pipe witness (Fnd.) in an old fence line on point bears N. 12DEGREES 38` 43DEGREES E. 357.29` thence leaving the tract of land owned by Reba Stowasser and running with the land owned by Don K. and Shirley L. Smith. N. 53DEGREES 07`29″ e. 121.01` to the place of beginning, containing 0.403 acres, more or less, and more fully described on a plat prepared by True Line Surveying, Inc. Being the same real estate conveyed unto John D. Adkins, by Michelle L. McCallister, by virtue of deed dated January 21, 2013, recorded 02 6, 2013 in Deed Book 1274, Page 250, Cabell County, WV Records. Being the same property conveyed to John Adkins by the Deed dated January 21, 2013 and recorded in Deed Book 1274 at Page 250 in the Office of the Clerk of the County Commission of Cabell County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and r the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and r belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
