NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and John M. Harshbarger, by that certain Deed of Trust made by Bradley S. Pittman, single, dated December 20, 2004 and recorded December 27, 2004 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 3204, at page 813, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated July 13, 2023 and recorded July 17, 2023 in the aforesaid Clerk’s office in Trust Deed Book 4651, at page 86, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on Tuesday, October 24, 2023 at 11:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in the City of Charleston, Charleston South Annex District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All those two (2) certain lots or parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate and being in the City of Charleston (Charleston South Annex), Kanawha County, West Virginia, and being known, lettered and designated as Lot “A” of the Walter Clark Land, and a parcel of land abutting and adjoining said Lot “A” on the East, fronting fifty (50) feet on Clark Road, the said two (2) parcels of land fronting seventy (70) feet on Clark Road, said two (2) parcels of land being set out, laid down and designated on a map or plat entitled, “Being Part of Clark Hill Property and Lot ‘A’ Walter Clark Land in the South Hills Loudon District Kanawha County W Va.”, made by J. Lewis Hark, Reg. Prof. Engr., dated July 12, 1958, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1255, page 136, and being more particularly bounded and described as follows: Beginning at an iron pin in the southerly right of way line of Clark Road, said iron pin being located at the front common corner of Lots A and B as shown on the aforesaid map; thence with the southerly right of way line of Clark Road, N. 55 40′ E. 20 feet to a point, said point being at the northeasterly corner of Lot A as shown on the aforesaid map; thence continuing with the southerly right of way line of Clark Road, N. 63 40′ E., 50 feet to an iron post, said iron post being located at the front common corner of the real estate herein conveyed and a tract or parcel of real estate heretofore conveyed by Ira Clark, widower, to Harry R. Lynch and Elizabeth Lynch, his wife, by deed dated November 13, 1950, and recorded in the aforesaid Clerk’s Office in Deed Book 937, at page 373, said tract or parcel of real estate being designated as Tract No. 1 in said deed; thence with the common division line of the tract or parcel of real estate herein conveyed and the said tract or parcel of real estate heretofore conveyed to Harry R. Lynch and Elizabeth Lynch, his wife, S. 9 20′ E., 116.88 feet to an iron pin; said iron pin being also located in the northerly right of way line of Skyline Road; thence with the northerly right of way of Skyline Road, S. 74 29′ W., 50 feet to an iron pin, said iron pin being located at the rear common corner of Lots A and B as shown on the aforesaid map; thence with the common division line between Lots A and B, N. 19 2′ W., 101.1 feet to the place of beginning. And being the same property conveyed unto Bradley S. Pittman by Warren A. Engstrom by deed dated June 7, 1999, of record in the aforesaid Clerk’s Office in Deed Book 2473, at page 684. At the time of execution of the deed of trust, the grantor represented that the address of the property was 1580 Clark Road, Charleston, WV 25314. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and City National Bank shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
