TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 24, 1991, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 1999, at Page 970, Richard E. Hardison and Mary Ann Hardison did convey unto James L. Whytsell and Phyllis H. Arnold, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on October 25, 2023, at 5:50 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Charleston South Annex District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, and being more particularly bounded and described as follows: Beginning at a concrete monument (set) in the westerly line of a new 40 foot private road, said beginning point being located N. 23 degrees, 53′ W. a distance of 489.20 feet from an old railroad spike in the present pavement of Loudon Heights Road and in the easterly right of way line of at the common corner to a tract of land presently owned by Chilton Realty & Development Company and 1266 corporation and also being located at the southwesterly corner of an easement for ingress and egress granted to said Chilton Realty & Development Company by said 1266 Corporation dated December 20, 1978, and recorded in the Office of the Clerk of the County Commission of Kanawha County, in Deed Book 1892, at Page 83, said beginning is also located in the most easterly corner of a parcel of land containing 1.057 acres as described in that certain Deed from Chilton Realty & Development Company to Robert M. Chilton and Helen Z. Chilton dated October 13, 1982 and recorded in the aforesaid Clerk’s Office in Deed Book 2015, at Page 704, and running thence from said beginning point with the northerly line of said 1.057 acre parcel or said Robert M. Chilton and Helen Z. Chilton reversed N. 65DEGREES 1.1′ W. passing a concrete monument (set) at 161.85 feet, passing another concrete monument (set) at 215.81 feet and continuing on in the same straight line in all a distance of 251.31 feet to a stake in the easterly line of Loudon Heights Road, said point is also located at the most northerly corner of said 1.057 acre hereinbefore referred to: thence leaving said 1.057 acre parcel and N. running with the easterly line of said Loudon Heights Road with a curved line to the right N. 39DEGREES 07′ E. a chord distance of 326.32 feet to a stake: thence leaving said Loudon Heights road running S. 36DEGREES 181 E. passing a concrete monument (set) at 26.30 feet passing another concrete monument (set) E. 106.87 feet and continuing on the same straight line in all a distance of 262.75 feet to a concrete monument (set) in the westerly line of said new 40 foot private road; thence running with said 40 foot private road with a curve line to the left with two chords thereof S. 49DEGREES 58′ W. a chord distance of 100 feet to a concrete monument (set): thence running E. 34DEGREES 52′ W. a chord distance of 100.0 reel to the place of beginning, containing once acre and four hundred sixty-seven one-thousandths of another acre, (1.467 acres), more or less. According to a survey made on the ground by a field engineering company and a map prepared there forth titled, “Parcel of land located in the City of Charleston, W. VA. presently owned by Chilton Realty & Development Company to be conveyed to Ronald Duncan & Vicki Duncan” on a scale of one inch equals one hundred (100) feet and dated October 6, 1982, which map is recorded in said Clerk’s Office in Deed Book 2018, at Page 435. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 6 Wildacre Road, Charleston, WV 25314. AND BEING the same real estate which was conveyed to Richard E. Hardison and Mary Ann Hardison, by Deed dated May 15, 1991, from Victoria A. Duncan and C. Ronald Duncan, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2271, at Page 777. AND BEING the same real estate which was conveyed from Richard E. Hardison to Mary Ann Hardison, Richard E. Hardison Jr., and Mary Ann Hardison, as custodian for John B. Hardison, by Deed dated November 26, 1995, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2463, at Page 783.The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
