NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and John M. Harshbarger, by that certain Deed of Trust made by Alfred L. Moore and Ethel Moore, dated December 18, 2000, and recorded December 19, 2000 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 2671, at page 207, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated September 22, 2023, and recorded October 2, 2023, in the aforesaid Clerk’s office in Trust Deed Book 4663, at page 113, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on Monday, November 6, 2023 at 11:15 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Charleston West District, Kanawha County, West Virginia, on the West side of Elk River and more particularly bounded and described as follows, to-wit: BEGINNING at a point in the northerly line of Cloumbia Boulevard, which said point is 258.1 feet in an easterly direction measured on said line from the easterly line of Burlew Street; thence by a line at right angles to said Columbia Boulevard and in a northerly direction 120 feet to the southerly line of an alley alley running parallel to said line of Cloumbia Boulevard; thence with said line of said alley in an easterly direction 40 feet to a stake; thence by a line at right angles to said Cloumbia Boulevard in a southerly direction 120 feet to said line of Cloumbia Boulevard; thence with said line of Cloumbia Boulevard in a westerly direction to the beginning, said lot being composed of a strip 1.9 feet wide of the easterly side of Lot 15 of Block “J” of Fitzgerald’s Addition of the City of Charleston, and the westerly 38 feet of Lot 16 of Block “J” of said addition, And being the same property as was conveyed unto Katherine B. Robinson, widow, by Bertie B. McMeans, widow, by deed dated the 4th day of September, 1956, of record in the aforesaid Clerk’s Office in Deed Book 1186 at page 333, and the said Katherine B. Robinson, having died testate, devised said property unto Alfred L. and Ethel Moore by Will of record in the aforesaid Clerk’s Office in Will Book 587 at page 687. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. In addition to the payment of the bid, the purchaser of said property at the sale, shall be responsible for paying a 10% buyer’s premium to Joe R. Pyle Complete Auction & Realty LLC immediately at the conclusion of the auction. This buyer’s premium is in addition to the winning bid amount. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and WesBanco Bank, Inc., shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
