NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and John M. Harshbarger, by that certain Deed of Trust made by A.A. Jet, Inc., dated July 7, 2015, and recorded July 13, 2015 in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Trust Deed Book 4111, at page 863, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated August 1, 2023, and recorded August 9, 2023 in the aforesaid Clerk’s office in Trust Deed Book 4654, at page 523, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Kanawha County, West Virginia, on Monday, November 6, 2023 at 11:00 a.m., all that certain lot, piece or parcel of real property, together with improvements thereon, situate in South Charleston, Spring Hill District, Kanawha County, West Virginia, being more particularly bounded and described as follows: All those certain parcels or real estate together with improvements thereon and the appurtenances belonging to Grantor, situate in Spring Hill District of Kanawha County, West Virginia, described as follows: Parcel One: Situate on U. S. Route 60 and being Lots Nos. 1, 2, 3, 4, 5, 6, 7, 8, 9 and 10, Block C, Williamson Addition to Spring Hill, as shown upon a map of said lots dated March 26, 1963, made by James Sell, C.E., which map is of record in the Kanawha County Clerk’s Office in Deed Book 1395, at Page 368-A. Parcel Two: Being known and designated as all of Lots Nos. Eleven (11), Twelve (12) and Thirteen (13) of Block “C” of the Williamson Addition, as shown upon a map of the same, recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Map Book 2, at Page 127. There is hereby expressly excepted from this conveyance those certain rights of way heretofore granted to the State Road Commission over part of the above described property. This conveyance is made subject to the flowage easements heretofore granted to the United States of America. Parcel Three: Being the rest, residue and remainder of Lot 14, Block C of said Williamson Addition to Spring Hill. Original Lot 14 was conveyed to Grantor by deed dated July 18, 1969, signed by B. H. Wood, recorded in the Kanawha County Clerk’s Office in Deed Book 1562, at Page 449. By deed July 7, 1977, Grantor outconveyed 0.40 of an acre out of said lot unto G. E. Ray Construction Co. recorded in Deed Book 1836, at Page 288. The metes and bounds description of Grantor’s remaining tract, herewith conveyed by Grantor unto Grantee, is as follows: BEGINNING at a old 1/2 inch iron pipe found corner to the Lazy-Two Inc. tract recorded in Deed Book 1395, Page 367, and the Pond Fork Oil & Gas tract recorded in Deed Book 1562, Page 449, said point being corner to Lots 5, 8 and 14 and also being in the northerly side of access road; thence leaving said road and running through said Lot 14 and with the Ahern & Associates tract recorded in Deed Book 2314, Page 21, N. 49 degrees 46′ W. 150.95 feet to a point, corner to Lots 12 & 14; thence with Lots 8 thru 12 for five calls: 1) N. 80 degrees 39′ E. 38.43 feet to a point corner to Lots 11 and 12; 2) N. 73 degrees 17′ E. 44.60 feet to a point corner to Lots 10 & 11; 3) S. 80 degrees 47′ E. 32.31 feet to a point corner of Lots 9 & 10; 4) S. 32 degrees 25′ E. 33.54 feet to a point corner to Lots 8 & 9; 5) S. 10 degrees 25′ W. 84.48 feet to the place of beginning. Being the same property conveyed unto AA Jet, Inc., a West Virginia corporation by deed dated March 26, 2001 and recorded in Deed 2521, at page 190. Parcel Four: All of that certain tract of land, shown on the plat attached hereto and made a part hereof, situate in Spring Hill District, Kanawha County, West Virginia, and more particularly described as follows: EXCESS LAND BEGINNING at a point in the southern existing right of way line of US Route 60 and in the southern revised noncontrolled access right of way line, said point being in the southern original right of way line of US Route 60 and 55 feet radially left of US Route 60 centerline at Station 110+00, Project SNFA 222(21), Kanawha County, West Virginia; thence, S. 34 15′ W., with said original right of way line 8 feet, more or less, to a point 63 feet radially left of centerline at Station 110+00; thence, N. 55 16′ W., continuing with said original right of way line 50 feet, more or less, to a point 63 feet radially left of centerline at Station 110+50; thence, S. 35 14′ W., continuing with said original right of way line 37 feet, more or less, to a point 100 feet radially left of centerline at Station 110+50; thence, N. 53 55′ W., continuing with said original right of way line 88.54 feet, more or less, to a point in the division line between Ahern and Associates and AA Jet, Inc., said point being in the southern revised noncontrolled access right of way line and 100 feet radially left of centerline at Station 111+38.54; thence, N. 40 53′ E., with said revised right of way line 45.11 feet, more or less, to a point 55 feet radially left of centerline at Station 111+38.54; thence, S. 54 26′ E., continuing with said revised right of way line 133.95 feet, more or less, to the place of beginning and containing 4,283.98 square feet (0.098 acre), more or less. Being the same property conveyed unto A. A. Jet, Inc., by deed dated May 4, 2010, from Pond Fork Oil and Gas Company, a West Virginia corporation, of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia in Deed Book 2772, at page 474. At the time of execution of the deed of trust, the grantor represented that the address of the property was 5701 MacCorkle Avenue SW, South Charleston, WV 25309. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The property will be sold for cash in hand on the date of sale to the highest bidder. In addition to the payment of the bid, the purchaser of said property at the sale, shall be responsible for paying a 10% buyer’s premium to Joe R. Pyle Complete Auction & Realty LLC immediately at the conclusion of the auction. This buyer’s premium is in addition to the winning bid amount. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and WesBanco Bank, Inc., shall not be responsible for the removal of any person or personal property from the Premises. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
