ORDER OF PUBLICATION The object of the above-entitled action is to obtain title free and clear of any right, title, or interest of the Defendants, in and to property known as 240 6th Avenue, West, Huntington, Cabell County, West Virginia, and more particularly described as follows: All that certain lot, piece and parcel of ground, situate in the City of Huntington, Cabell County, West Virginia, known and designated on that certain map of Carrington Court Sub-division, which said map was filed in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on March 31, 1939 in Map Book 4, as Map 16, as Lot No. Fifty (50), and more particularly described as follows: BEGINNING at the point of intersection of the north line of Sixth Avenue (west) with the west line of Carrington Court; thence with said line of Sixth Avenue westerly 45.5 feet; thence northerly and parallel to said line of Carrington Court 80 feet; thence easterly and parallel to said line of Sixth Avenue 45.5 feet to a point in said line of Carrington Court; thence with said line southerly 80 feet to the point of Beginning; reserving however the northerly or rear 5 feet as a sewer and utility easement. Chafin, and Plat, of record in Deed Book 1159, Page 474, Cabell County Recorder’s Office, more particular!y described as follows: All that certain lot or parcel of property on Sixth Avenue (West) and Court Street in the City of Huntington, Cabell County, West Virginia being more particularly described as follows: Lot #50 Carrington Court Subdivision Beginning at rebar and cap (set) at the point of intersection of the north right of way line of Sixth Avenue (West) with the west right of way line of Court Street; Thence leaving Court Street and running with the north right of way line of Sixth Avenue (West), South 79-51-28 West 45.50 feet to a rebar and cap (set) at the southeast corner of Lot #49 Carrington Court owned by Pauline R. Nohe (DB 481 PG 456); Thence leaving Sixth Avenue (West) and running with the east line of Lot #49, North 10-18-26 West 80.00 feet to a pk nail (set) at the south line of Lot #21 owned by Mary F. Mullins (DB 1133 PG 512); Thence leaving Lot #49 and running with the south line of Lot #21, North 79-51-27 East 45.50 feet to a cross chiseled in concrete at the west right of way line of Court Street; Thence leaving Lot #21 and running with said right of way line, South 10-18-26 East 80.00 feet to the point of beginning containing 3,640 square feet or Eighty Four Thousandths (0.084) Acre and being subject to a five foot wide utility easement as shown on the accompanying plat of survey and on the plat of Carrington Court Subdivision (Plat Book #4 Map #16). It appearing by affidavit filed in this action that the Plaintiffs, herein, used due diligence to ascertain the whereabouts of the Defendants, without success, it is ORDERED, that the Defendants, above named, serve upon Bruce A. Toney, Plaintiffs’ attorney, whose address is 1002 Third Avenue, Huntington, West Virginia 25701, an answer or other defense to the Complaint filed in this action on or before the 9th day of February 2024, otherwise judgment by default will be taken against the Defendants at any time thereafter.
