Patrick Guthrie, Ingrid Guthrie, Defendants Order of Publication Plaintiff, Nationstar Mortgage LLC, (“Plaintiff”), by counsel, pursuant to Rule 4(e)(1)(C), submits this Order of Publication to effect service by publication in the action captioned Nationstar Mortgage LLC, Plaintiff, v. Patrick Guthrie and Ingrid Guthrie, Defendants, Civil Action No. 23-C-391, for Defendants, Patrick Guthrie and Ingrid Guthrie (“Defendants”). The above-referenced action was filed to address a transcription error, specifically, that the legal description of the subject property in the deed of trust does not correspond with the legal description of the subject property in the deed. A copy of the Petition may be obtained from the Clerk of Cabell County, West Virginia by referencing the Civil Action number above. Defendants cannot be located despite due diligence following extensive public records searches as well as employment of a private investigator to locate them. Each Defendant is required to appear or submit a response within thirty (30) days of the first day of the second week after the first publication, otherwise a judgment by default will be rendered against any Defendant who does not appear or respond. IT IS THEREFORE ORDERED that Plaintiff be and hereby is granted leave to serve Defendants, Patrick Guthrie and Ingrid Guthrie, via publication; IT IS FURTHER ORDERED that such publication shall be made once a week for two consecutive weeks in the Huntington Herald-Dispatch in accordance with West Virginia Rule of Civil Procedure 4; and IT IS FURTHER ORDERED that service shall be complete at the expiration of the first day of the second week after the first publication; and IT IS FURTHER ORDERED that the Defendants are required to serve their written answer with the Clerk of this Court, and with a copy of said answer served upon Plaintiff’s attorney within THIRTY (30) days after constructive service of this summons.
